City 4f <br /> pegof <br /> es <br /> NEW BUSINESS—FENCE LOCATION DISCUSSION <br /> Agenda Item: 6 (c) <br /> Background Information: While doing research a few months ago Chair <br /> Engels came across the following language in the zoning ordinance for the City of <br /> Maple Grove and felt it warranted discussion for a potential Ordinance <br /> Amendment. <br /> "No fence on a corner lot shall be erected within the triangular area described <br /> below: Traffic Visibility: On corner lots in all districts, no structure or planting <br /> in excess of thirty (3o) inches above the street center line grade shall be <br /> permitted within a triangular area defined as follows: Beginning at the <br /> intersection of the projected property lines of two intersecting streets, thirty <br /> (3o)feet along one property line and diagonally to a point thirty (3o)feet from <br /> the point of beginning on the other property line." <br /> Applicable Regulations: <br /> Section 17-5.6 RURAL RESIDENTIAL (RR) <br /> Fences. Fences not exceeding 72 inches in height may be constructed. <br /> Under no circumstances shall a fence be constructed closer than 10 <br /> feet from the surface of a public road and in all cases not within the <br /> public right-of-way. Materials shall consist of usual fencing <br /> materials with posts and fence of metal, wood, concrete,brick or <br /> smooth wire. Barbed or electrified wire is not to be used where <br /> frequent human contact is anticipated. <br /> Section 17-5.7 TRANSITION RESIDENTIAL (TR) <br /> Fences. Fences not exceeding 72 inches in height may be constructed. <br /> Under no circumstances shall a fence be constructed closer than 10 <br /> feet from the surface of a public road and in all cases not within the <br /> public right-of-way. Materials shall consist of usual fencing <br /> materials with posts and fence of metal,wood, concrete,brick or <br /> smooth wire. Barbed or electrified wire is not to be used where <br /> frequent human contact is anticipated. <br /> Section 17-5.8 SHORELINE RESIDENTIAL (SR) <br /> Fences. Fences not exceeding 36 inches in height may be constructed <br /> within the OHW setback area so long as the fencing is transparent. <br /> Fences not exceeding 72 inches in height may be constructed up to <br /> the OHW setback area.
