CITY OF PEQUOT LAKES <br />RESOLUTION NO. 09-32 <br />A RESOLUTION VACATING A PORTION OF FIRST STREET (ALLEY) <br />BLOCK ONE, <br />FIRST ADDITION TO COLE'S PLAT OF PEQUOT <br />CROW WING COUNTY <br />WHEREAS, a petition signed by a property owner, CLA Properties, LLC, abutting First <br />Street (Alley) (a portion of) in Pequot Lakes was received by the City Clerk on the 1St day of <br />September, 2009 (the "Petition "); and <br />WHEREAS, the Petition requested that the City of Pequot Lakes (the "City "), pursuant <br />to Minnesota Statute §412.851, vacate First Street (Alley) legally described as: <br />That part of the 16.00 foot alley as dedicated in the plat of FIRST ADDITION TO <br />COLE'S PLAT OF PEQUOT, Crow Wing County, Minnesota, lying Northerly of <br />the Easterly extension of the South line of Lot 9, Block 1, said plat; and <br />WHEREAS, the City Clerk reviewed and examined the signatures on said Petition and <br />determined that said signatures constituted 50% of the landowners abutting upon the First Street <br />(Alley) (portion of) to be vacated; and <br />WHEREAS, after review of the underlying fee title to the property abutting and located <br />to the east of the sections of First Street (Alley) described in the Petition the City determined that <br />the City was the title holder to the property; and <br />WHEREAS, the City determined at the regular City Council Meeting on October 6, <br />2009 to join the Petition thereby meeting the statutory requirement of a majority of property <br />owners joining the Petition; and <br />WHEREAS, a public hearing was held on October 6, 2009 before the City Council in the <br />City Hall after due published and posted notice had been given by the City Clerk on September <br />17, 2009, including mailed notice to all property owners within the plat of FIRST ADDITION <br />'� <br />
