Type 4 — Ten acres of mixed Norway and jack pine located in two areas. The <br /> recommendation is to thin out the mature aspen, birch and jack pine, reserving <br /> the Norway pine and oak. <br /> * ** * * <br /> Paul Reschke has indicated that the south property line has been flagged from <br /> County Road 107 to State Highway 371. Flags should be removed from the <br /> Donald Reschke property to avoid confusion. <br /> The City of Pequot Lakes issued a Cease and Desist Order April 7, 2017 to halt the <br /> logging activities that had begun in the Shoreline Residential zone. Mr. Reschke <br /> did cease logging activities and made application to rezone the property to Rural <br /> Residential which was approved by the City Council July 6, 2017. The City <br /> Council is anticipating a recommendation from the Planning Commission <br /> regarding a penalty. The"After-the-Fact Fee" is 5 times the base fee (included) <br /> with a minimum penalty of$300.00. Mr. Reschke has paid the $125 base fee. <br /> Applicable Regulations: <br /> Section 17-3.2. DEFINITIONS <br /> 249. Vegetation Removal,Intensive. The removal of more than 50% and up <br /> to 100%of a stand of trees and brush over 10 feet in height on a lot or <br /> parcel of land up to 40 acres. <br /> Section 17-5.6 RURAL RESIDENTIAL (RR) <br /> 1. Purpose and Intent: To provide a zoning classification that allows for low- <br /> density residential development. Development in this zone is without municipal <br /> utility service and with only limited demand for accessibility. Rural Residential <br /> zoning should be used to preserve rural character. <br /> 2. Compatibility: The Rural Residential zone is compatible with and can be <br /> established adjacent to Forest Management and Agriculture zones,but may not be <br /> completely surrounded by those zones. The Rural Residential zone must be <br /> adjacent to land zoned Rural Residential, Transition Residential, Light Industrial <br /> or Commercial. The Rural Residential zone may be established next to the <br /> Shoreline Residential zone or the Water Resource zone. <br /> 3. Lot, Use and Density Requirements. <br /> Lot Width-feet,minimum 200 <br /> Buildable Lot Area- acres, minimum 5 <br /> Setback,right-of-way, local streets - feet,minimum 50 <br /> Setback, right-of-way, collector and arterial streets <br /> - feet, minimum 50 <br /> Pequot Lakes Staff Report 7(b)-2 <br /> July 20,2017 <br />
