that the City does not have statutory authority to expend <br /> public funds to the FOPLCL on this matter per the <br /> following. <br /> • When funds were given to the City from the FOPLCL, <br /> they were recognized as a donation to the City by <br /> resolution. Upon adoption of the resolutions, these <br /> funds then became public funds. <br /> • City expenditures of public funds must serve both a <br /> public purpose and be based on statutory authority. <br /> The City Auditor and Attorney were unable to find <br /> statutory authority that would authorize the <br /> expenditure requested by the FOPLCL. Attached are <br /> e-mails from City Attorney Chris Hood for your <br /> review. <br /> • If the expenditure of funds is approved as requested by <br /> the FOPLCL, a State legal compliance finding would <br /> be noted on the City's audit report for 2017. This <br /> finding would note that the City made an expenditure <br /> that was not allowable under State law and the Office <br /> of the State Auditor would receive notification. <br /> Council Action Requested: Council motion to approve or <br /> deny the expenditure of monies in the amount of <br /> $123,661.38 as requested by the Friends of the Pequot <br /> Lakes Community Library. <br />
