City Council Special Meeting Minutes <br /> May 2, 2017 <br /> Page2of3 <br /> • Remove all piles of tree limbs, branches, brush and similar natural <br /> debris from the Property. <br /> • Remove the trailers currently located on the northeast corner of the <br /> Property or store within a structure. <br /> • Remove all ladders, lumber, construction materials from the Property <br /> or store it within a structure. <br /> • Remove the entirety of the pile of tires, buckets, garbage cans, <br /> construction materials, garbage, solid waste or other debris from the <br /> Property. <br /> • Remove the piles of miscellaneous debris from the patio/deck side of <br /> the dwelling (firewood is okay). <br /> • Store the bicycles in a pile of other debris at the rear of the Property in <br /> a shelter and remove the entirety of the rest of such pile of <br /> miscellaneous debris from the Property. <br /> Deadline of September 1, 2017 <br /> • For each snowmobile or similar off-road recreational vehicle on the <br /> Property, either remove it from the Property or store it within a <br /> structure. <br /> Furthermore, after June 13, 2017, the City can enter the Property to <br /> conduct an inspection to determine if any of the corrective actions to be <br /> completed by the June 13, 2017 deadline remain uncorrected or whether <br /> any other code violations exist. For any such uncorrected code <br /> violations, the City would then issue a one-time notice allowing the <br /> Property Owner ten additional days to comply. After the extension, the <br /> City can abate the remaining code violations on the Property and assess <br /> all City costs incurred against the Property. The Property Owner has <br /> agreed to pay $500 in City attorney fees incurred in addressing this issue, <br /> but the City could not assess more than this amount against the Property. <br /> City Attorney Scott explained that the remedy provided for in the <br /> agreement in the event Mr. Derksen does not perform the corrective <br /> actions, City authority to enter the Property and perform the corrective <br /> actions itself and assess such costs against the Property, is the same <br /> remedy the City would request from the district court if the City did not <br /> enter into the agreement and had to take legal action against the Property <br /> Owner. <br /> City Attorney Scott recommended approval of this tentative agreement. <br /> Mark Severson addressed the Council. He noted that this agreement will <br /> not set Mr. Derksen up to fail. Mr. Severson requested that all red-lined <br /> agreement items he gave to the City Attorney be incorporated into the <br /> agreement. <br />
