Hood, <br /> City Attorneys, City of Pequot Lakes VIA EMAIL <br /> Date: June 2,2017 <br /> Re: CITY COUNCIL HEARINGS TO CONSIDER ORDERING ABATEMENT <br /> of City Ordinance Violations at 3952 County Road 17 and 31051 Pine Street, <br /> Pequot Lakes,MN 56472 <br /> The following memorandum briefly addresses the process we recommend the City Council of <br /> the City of Pequot Lakes (City) follow in considering whether to declare the conditions at the <br /> properties owned by Robert and Kimberly Swenson at 31051 Pine Street(Swenson Property) <br /> and Virgil Dahl at 3952 County Road 17 (Dahl Property) in the City to be a public nuisance and <br /> violations of City Ordinances at a special meeting to be held on June 6, 2017 at 5:30 p.m. The <br /> City Council will also be asked to consider making a hazardous building/hazardous property <br /> declaration(30892 South Heath Street) in this special meeting under a separate statutory <br /> procedure, and receive an update on the property at 30892 South Heath Street addressed by the <br /> City Council at a special meeting held on May 2, 2017. <br /> The Swenson Property has miscellaneous items accumulated in plain site along its south lot <br /> line, and deterioration of the dwelling, attached garage and accessory structure in violation of <br /> the City's Code of Ordinances and nuisance regulations. A letter from the City's Zoning <br /> Specialist to Robert and Kimberly Swenson, dated March 24, 2017, includes quotations from <br /> the applicable city ordinances, and is appended hereto (Appendix A-1) for the City Council's <br /> reference and consideration in advance of the special meeting. The property owners have made <br /> some improvements since receiving the notice of violations from City staff(removing the lean- <br /> to next to the garage,the small building behind the garage, and the abandoned truck), but code <br /> violations and nuisance conditions remain on the property. <br /> The Dahl Property has garbage,junk, construction materials, brush/branches, furniture, <br /> abandoned vehicles,tires and other debris to accumulate in plain sight on the Property, and <br /> despite repeated written notifications and requests by City staff and the City Attorney, such <br /> debris has not been removed. The following background documents, which include quotations <br /> from the applicable city ordinances, are appended hereto for the City Council's reference and <br /> consideration in advance of the special meeting: <br /> • Appendix B-l: Letter Agreement between Virgil Dahl and City dated July 7, 2016; <br /> • Appendix B-2: Zoning Specialist letter to Virgil Dahl, dated April 21,2017; and <br /> • Appendix B-3: City Administrator notes from site visits to Dahl Property. <br />
