ORDINANCE NUMBER 17-_, SECOND SERIES <br /> AN ORDINANCE AMENDING CHAPTER 17 OF THE CITY CODE <br /> REGARDING A FLOODPLAIN MANAGEMENT <br /> OVERLAY DISTRICT <br /> CITY OF PEQUOT LAKES <br /> COUNTY OF CROW WING <br /> STATE OF MINNESOTA <br /> The City Council of the City of Pequot Lakes does ordain as follows: <br /> Purpose and Intent: The purpose and intent of this ordinance is to amend Chapter <br /> 17 of the Pequot Lakes City Code relating to a Floodplain Management Overlay District. <br /> Amendment: Chapter 17,Article 6, Overlay Districts and District Provisions shall be <br /> amended to add a new Section 17-6.8 as follows: <br /> Section 17-6.8 FLOODPLAIN MANAGEMENT OVERLAY DISTRICT <br /> 1.0 Statutory Authorization and Purpose: <br /> 1.1 Statutory Authorization: The legislature of the State of Minnesota <br /> has,in Minnesota Statutes Chapter 103F and Chapter 462, <br /> ``- delegated the responsibility to local government units to adopt <br /> regulations designed to minimize flood losses. <br /> 1.2 Purpose: <br /> 1.21 This ordinance regulates development in the flood hazard <br /> areas of Pequot Lakes. These flood hazard areas are subject <br /> to periodic inundation,which may result in loss of life and <br /> property,health and safety hazards, disruption of commerce <br /> and governmental services, extraordinary public <br /> expenditures for flood protection and relief, and impairment <br /> of the tax base. It is the purpose of this ordinance to <br /> promote the public health, safety, and general welfare by <br /> minimizing these losses and disruptions. <br /> 1.22 National Flood Insurance Program Compliance. This <br /> ordinance is adopted to comply with the rules and <br /> regulations of the National Flood Insurance Program <br /> codified as 44 Code of Federal Regulations Parts 59 — 78, as <br /> amended, so as to maintain the community's eligibility in the <br /> National Flood Insurance Program. <br /> 1 <br />
