NEW BUSINESS: <br /> a. Larry&Cynthia Johannessohn,Applicants <br /> Applicants request a Metes and Bounds Subdivision <br /> Mr. Burslie explained the Staff Report. Applicant was not present. An updated <br /> Certificate of Survey was provided for each Commission Member;the"Sale Tract"had <br /> been reduced in size. <br /> Mr. Burslie stated the survey indicates the impervious coverage for Tract A is 57.2%. <br /> The property owner has applied for and received a Land Use Permit to construct an <br /> addition to the structure. The site plan for the addition reduces the impervious coverage <br /> to 50%,the maximum in the Downtown Mixed Use Zone. He further stated an <br /> additional Finding of Fact should read: <br /> 13. The impervious surface coverage of Tract A is 57.2%and Tract B is 22.8%. <br /> Tract A has been granted a permit for an addition with the condition that they <br /> need to reduce the overall impervious coverage to 50%. <br /> Mr. Burslie further stated the accessory structure on Tract B is 2.04 feet from the <br /> proposed property line. The setback requirement in the Downtown Mixed Use Zone is <br /> zero feet. They can go up to the property line but they can't overhang the property line <br /> with eaves. <br /> Council Member Akerson asked if the Sale Tract is a buildable lot. Mr. Burslie stated the <br /> Sale Tract will be consolidated with Tract A. <br /> Planning Commission Member Hallan stated the Certificate of Survey indicates a <br /> sanitary sewer line along the east side of Tract A with no indication of an easement. He <br /> stated he is vehemently opposed to the subdivision with no easement for the sanitary <br /> sewer line. <br /> Mr. Burslie stated with roadways, if the road is not constructed within the designated <br /> right-of-way,the municipality has a prescriptive easement. Discussion followed and it <br /> was the consensus of the Planning Commission that a legal easement is necessary for a <br /> sanitary sewer line. <br /> A MOTION WAS MADE BY PLANNING COMMISSION MEMBER WILSON, <br /> SECONDED BY PLANNING COMMISSION MEMBER HABEIN,TO TABLE <br /> THE METES AND BOUNDS SUBDIVISION.
