City of <br /> Pequot <br /> CSC <br /> PUBLIC HEARING—WETLAND SETBACKS <br /> Application: Ordinance Amendment regarding Wetland Setbacks <br /> Applicant: City of Pequot Lakes <br /> Agenda Item: 3 (c) <br /> Background Information: The current City Code contains wetland setback <br /> requirements in all zoning classifications except Shoreline Residential and Urban <br /> Residential. The minimum setback is 50 feet in those zones, except Light <br /> Industrial which is 75 feet. Wetland is described as: <br /> 253. Wetland. Lands transitional between terrestrial and aquatic <br /> systems where the water table is usually at or near the surface or <br /> the land is covered by shallow water. For the purposes of this <br /> definition,wetlands must have the following three attributes: <br /> A. have a predominance of hydric soils, <br /> B. are inundated or saturated by surface or groundwater at a <br /> frequency and duration sufficient to support a prevalence of <br /> hydrophytic vegetation typically adapted for life in saturated <br /> soil conditions, and <br /> C. under normal circumstances support a prevalence of such <br /> vegetation. <br /> Local wetland setback requirements: <br /> MUNICIPALITY DISTANCE IN FEET <br /> Breezy Point 30 <br /> Crow Wing County 15 <br /> Fifty Lakes 20 <br /> Lake Shore 30 <br /> Nisswa 30 <br /> Pequot Lakes 50 <br /> The Wetland Conservation Act does not contain a structure setback for wetlands. <br /> Pequot Lake's Ordinance may be excessive at 5o feet. <br /> Staff recommends the addition of a 3o-foot wetland setback in the Shoreline <br /> Residential and Urban Residential zoning classifications, as well as reducing the <br /> wetland setback requirements in all zones to 3o feet. <br /> Pequot Lakes Staff Report 3(c)-1 <br /> February 19,2017 <br />
