time during the Lease term, anywhere upon the irrigated Premises as depicted in <br /> Exhibit B. <br /> c. Tenant agrees to cultivate the irrigated and non-irrigated Premises in a careful and <br /> husband-like manner, and to protect all crops from injury and waste, and to cut no <br /> green trees and to commit no waste or damage on the Premises and to suffer none <br /> to be done; and to keep up and maintain in good repair all buildings, fences and <br /> other improvements on the Premises unless specifically agreed otherwise herein. <br /> Furthermore, the Tenant will be responsible for any repair and replacement costs <br /> of irrigation equipment that Tenant damages. <br /> d. The Tenant is also to destroy all Russian Thistles and other noxious weeds growing <br /> on the irrigated Premises, declared by statute to be common nuisances, within the <br /> time prescribed by law,and shall keep all roadways and other parts of the Premises, <br /> not in crop, mowed and free from growing weeds. The Tenant agrees to till the <br /> crop upon approval by City personnel. <br /> 6. Single Season Crop Rotation: The City has authorized a one growing season crop <br /> rotation on the Premises. The following rules and guidelines will be followed to keep the <br /> City in compliance with its NPDES Permit. The City reserves the right to discharge its <br /> ponds to the irrigation site regardless of the consequences to the Tenant's crop and the <br /> Tenant agrees that it waives any and all claims against the City with respect to the City's <br /> discharge of treated wastewater effluent on the Premises. <br /> 7. Irrigation Schedule: The irrigation system shall not interfere with the harvesting of crops <br /> on the Premises.The discharge of treated wastewater effluent through the irrigation system <br /> shall be at such times when Tenant is not in the process of harvesting crops, said times of <br /> harvest to be at the option of Tenant. The Landlord will irrigate when requested by Tenant, <br /> as long as weather conditions permit, but the Landlord reserves the right to irrigate if <br /> necessary to maintain acceptable levels of treated wastewater effluent in the wastewater <br /> treatment system ponds. The Tenant agrees to contact City personnel to determine <br /> appropriate harvest times. <br /> 8. Plant Operator: Landlord agrees that it will employ a certified wastewater treatment plant <br /> operator,and said certified operator will have completed the necessary training as required <br /> by the MPCA in the operation of the Wastewater Treatment Plant and the Fixed Spray <br /> Irrigation System. <br /> 9. Costs: The Landlord shall bear all costs related to the operation of the Fixed Spray <br /> Irrigation Systems on the Premises, including,but not limited to lubricants,electricity,and <br /> parts. <br /> 10. Insurance: The Landlord shall obtain and hold in effect an insurance policy covering <br /> damages and theft to the Fixed Spray Irrigation Systems located on the Premises. Tenant <br /> shall obtain and hold in effect an insurance policy covering all other personal property and <br /> 2 <br />
