CITY OF PEQUOT LAKES <br /> RESOLUTION 16-17 <br /> RESOLUTION ACCEPTING TRAILSIDE PARK DONATION <br /> WHEREAS, the City of Pequot Lakes (City) is generally authorized to accept <br /> donations of real and personal property pursuant to Minnesota Statutes, Section <br /> 465.03 for the benefit of its citizens in accordance with the terms prescribed by <br /> the Donor, and that acceptance of such grant is subject to a resolution of the City <br /> Council adopted by a two-thirds majority of its members, expressing the terms of <br /> the grant in full; and <br /> WHEREAS, a fund-holder from the FM Area Foundation (Donor) wishes to make <br /> a total cash donation to the City of Pequot Lakes of$250,000 with such donated <br /> funds designated for two projects in Trailside Park, as follows: <br /> 1. $150,000 to the City to design, develop and construct a state flag display; <br /> and <br /> 2. $100,000 to the City to design, develop and construct a splash park, <br /> (the "Projects"); and <br /> WHEREAS, the Donor wishes to provide these grants anonymously with no <br /> acknowledgement or identification of the Donor; and <br /> WHEREAS, the Projects are yet to be designed by the City, cost estimates for <br /> design and construction of the Projects and the same will be required before the <br /> City Council can approve one or more of the Projects, determine sufficiency of <br /> funding for the same, and put one or more of the Projects out for bid for purposes <br /> of future construction thereof; and <br /> WHEREAS, further conversations to determine the process and timeline to carry <br /> out the wishes of the Donor will also be considered in the Project process once <br /> the donation offer is accepted by the City of Pequot Lakes; and <br /> WHEREAS, the Projects are subject to subsequent future design, feasibility, <br /> location, approval, permitting, competitive bidding and contracting by the City <br /> Council in its discretion; and <br /> WHEREAS, the Projects are further subject to the extent such donated funds are <br /> sufficient to complete such Projects, or as one or more of such Projects may <br /> otherwise be additionally funded in the future by the City Council in its discretion; <br /> and <br />
