ANIMAL CONTROL ENFORCEMENT SERVICE AGREEMENT <br /> THIS AGREEMENT,made and entered into by and between,City of Pequot Lakes(to include the City of Jenkins), <br /> hereinafter referred to as the"CITY"and Animal Control Enforcement Services,hereinafter referred to as"CONTRACTOR". <br /> WHEREAS,CONTRACTOR wishes to enter into a contract with CITY,to provide service,labor and expertise as the CITY's <br /> Animal Control Officer. <br /> WHEREAS,CONTRACTOR is authorized to and capable of working elsewhere and is free to carry on any activity seen fit, <br /> within own discretion,provided that tasks undertaken for CITY are performed;and <br /> WHEREAS,CITY AND CONTRACTOR believe it to be in their respective best interest to enter into this Agreement according <br /> to the terms and conditions hereinafter set forth; <br /> NOW THEREFORE,IT IS AGREED BETWEEN THE PARTIES HERETO AS FOLLOWS: <br /> 1: CONTRACTOR shall apprehend and deliver back to the owner,if know,or to appropriate kennel facility approved and <br /> chosen by CITY,all animals found to be running at large,in violation of city animal ordinance,with in the CITY limits. <br /> 2: CONTRACTOR agrees to handle,as appropriate,services outlined and described in"ANIMAL CONTROL ENFORCEMENT <br /> PROPOSAL",a copy of which is attached. <br /> 3: CONTRACTOR shall provide a satisfactory motor vehicle to transport said animals. Said motor vehicle shall have motor <br /> liability insurance coverage for bodily in an amount not less than$100,000 per person. Proof of such insurance shall be furnished to <br /> the CITY. <br /> 4: CONTRACTOR shall maintain liability insurance for his services in the aggregate amount of$1,000,000 and shall include <br /> CITY as a named additional insured for the term of this agreement and an extensions thereof. Proof of such insurance shall be <br /> furnished to the CITY. <br /> IN CONSIDERATION OF THE FOREGOING,THE CITY AGREES AS FOLLOWS: <br /> 1:CITY shall pay CONTRACTOR agreed upon amount for services as described in"ANIMAL CONTROL ENFORCEMENT <br /> PROPOSAL",a copy of which is attached. <br /> ADDITIONAL TERMS: <br /> 1: CONTRACTOR is not an employee of CITY. <br /> 2: CONTRACTOR shall submit monthly reports to CITY as to animal control services rendered. <br /> 3: The term of this agreement shall be for one year from January 01,2017 thru December 31,2017;except that each party <br /> hereto has the right to terminate this agreement upon ninety(90)days written notice to the other party.Written notice shall be <br /> considered effective if sent certified mail to the following addresses: <br /> City of Pequot Lakes Animal Control Enforcement Services <br /> C/O city clerk C/O Donald C Hannahs JR <br /> 4638 CR#11 119 3`d Ave NE <br /> Pequot Lakes,MN 56472 Brainerd,MN 56401 <br /> IN WITNESS THEREOF,the parties have executed the Agreement on this day of ,2016. <br /> CITY OF PEQUOT LAKES ANIMAL CONTROL ENFORCEMENT SERVICES <br /> BY: BY: <br /> Mayor Donald C Hannahs JR,owner/operator <br /> BY: <br /> Administrator/Clerk <br /> CITY OF JENKINS <br /> BY: <br /> Mayor <br /> BY: <br /> Administrator/Clerk • <br />
