City of Pequot Lakes/Pull Tab Issue <br /> Our File No. 25000.064 <br /> Dear Sandy, <br /> I have reviewed the issue regarding a request by Minnesota Fishing Museum located in Little Falls, MN, <br /> for a permit to sell pull-tabs at the Speedstop Station. According to the Ordinance currently in effect <br /> regarding gambling, if an applicant meets the requirements of the Ordinance in applying for a permit,the <br /> City would have no basis for denying the application. The fact that the request is made by a party outside <br /> the City is not a basis for denial. <br /> As for the issue of requiring the applicant to spend a portion of its gross profits in the City,there is no <br /> provision in the City's Ordinances,which would authorize the City to impose this restriction. Minnesota <br /> Statute 349.213 gives authority to a City to require all or a portion of the organization's expenditures for <br /> lawful purposes to be spent in the City's trade area. However, in order to impose said restrictions upon the <br /> applicant,the City must have defined the City's trade area and the percentage of lawful purpose <br /> expenditures to be expended within the trade area in its Ordinances.The City's current Gambling <br /> Ordinance lacks the necessary language to impose restrictions as to how much and where an organization <br /> makes its lawful expenditures. <br /> If you have any questions or need additional information,please do not hesitate to contact me at(218)568- <br /> 8481. <br /> Sincerely, <br /> 1-1 koyu <br /> Stacy M.
