8. Adjacent construction to the west encroaches closer to the lake. The <br /> property directly adjacent to the east is undeveloped. Adding a second <br /> story to this structure would not alter the character of the surrounding area. <br /> 9. The existing deck is an integral part of the structure and ensures safe <br /> access from the first floor. <br /> The Commission further recommends that the following conditions be included in <br /> a motion to approve the variance: <br /> 1. At least five new trees shall be planted and maintained within the shore <br /> impact zone (first 37.5 feet from the lake)to ultimately buffer the visual <br /> impact of the second story addition. <br /> 2. There has been no easement agreement prepared or presented regarding <br /> utilities beneath Outlot G. <br /> 3. The abandoned building on Lot 6 has been removed. <br /> 4. The buried debris has been removed. This was observed by City Staff <br /> 5. The applicants have submitted a plat check on the subdivision. <br /> 6. The applicants have submitted a title opinion on the property. <br /> The Commission recommends that the motion to approve include the following <br /> conditions: <br /> 1. The deed restriction and title opinion shall be acceptable to the City <br /> Attorney. <br /> 2. A utility easement will be provided beneath Outlot G. <br /> We have provided you with a separate report detailing year-end budget items and permit <br /> summary. This thorough report is designed to give you added insight into how the <br /> Planning and Zoning Department runs. It includes some recommendations for 2004 that <br /> we will look to discuss with you at the upcoming meeting. <br />
