townships . N. "Residential Subscriber" means any subscriber who occupies a privately owned dwelling within the area on "Exhibit A" . O. "Seasonal Subscriber" means the following: 1 . With respect to Residential Subscribers , a Seasonal subscriber is a Subscriber who maintains a permanent residence and mailing address outside of the Interlake CableVision service area for at least 6 months of any calendar year ; 2 . With respect to Non-residential Subscribers , a Seasonal Subscriber is a subscriber whose place of business or units served by non-residential outlets are open for business 9 months or less in any calendar year . P. "Street " means each of the following which have been dedicated to the public or are hereafter dedicated to the public and maintained under public authority or by others and located within City and Township limits : street , road, highway, freeway, lane , alley, path, court , sidewalk , parkway or drive or any easement , right-of-way or similar public property. Q. "Technical Capability for Non-voice Return Communications" means the provision of system design which, with the installation of cable and amplifiers , would be suitable for the insertion of non-voice communication electronic modules . R. "Subscriber" means any Owners Association , Non-residential Subscriber , Residential Subscriber and Seasonal Subscriber . S . The word "shall" is mandatory. T. The word "may" is permissive . SECTION 2. COMPLIANCE WITH MINNESOTA STATUTES CHAPTER 238 A. This Franchise shall at all times be in compliance with Minnesota Statutes Chapter 238 . B . It shall be unlawful for any person to construct , operate or maintain a Cable System in the municipalities which comprise the Franchising Authority unless such person or the person for whom such action is being taken shall have first obtained and shall currently hold a valid Cable Communications Franchise . All Cable Communications Franchises granted by the Franchising Authority shall contain terms and conditions no more favorable nor less burdensome than those contained herein . SECTION 3 . COMPLIANCE WITH STATE AND FEDERAL LAWS A. The Franchisee and the Franchising Authority shall conform to all state laws and rules regarding cable communications not later than one ( 1 ) year after they become effective unless otherwise stated and to all Federal Laws and regulations regarding cable communications as they become effective .
