ORDINANCE NO. 2 <br /> AN ORDINANCE RENEWING A CABLE COMMUNICATIONS FRANCHISE AND RULES <br /> GOVERNING THE OPERATION OF SAME IN THE CITIES OF BREEZY POINT, PEQUOT <br /> LAKES AND JENKINS AND IN THE TOWNSHIPS OF JENKINS , SIBLEY AND PELICAN, <br /> CROW WING COUNTY, MINNESOTA PURSUANT TO A JOINT POWERS AGREEMENT BY AND <br /> BETWEEN THE ABOVE MUNICIPALITIES DATED <br /> WHEREAS, the Heartland Cable Commission has , following <br /> reasonable Notice ; conducted a full public hearing , affording all <br /> persons reasonable opportunity to be heard , which proceeding was <br /> concerned with the analysis and consideration of technical ability, <br /> financial condition , and legal qualifications of the Franchisee ; and <br /> WHEREAS , to the knowledge and belief of the Heartland Cable <br /> Commission this franchise and procedure used in formulating the award <br /> in all things and in all ways complies with the franchise standards of <br /> Minnesota Statutes Chapter 238 . <br /> NOW THEREFORE, the Heartland Cable Commission ordains that a <br /> cable communications franchise for the installation , operation , and <br /> maintenance of Cable Communication System within the Cities of Breezy <br /> Point , Pequot Lakes and Jenkins and the Townships of Jenkins , Sibley <br /> and Pelican , as set forth on the map labeled Exhibit A attached hereto <br /> made a part hereof by reference , is granted to Interlake <br /> \ICIBleVision , Inc . ; provided, however , that said franchise shall be <br /> subject to the following terms and performance conditions : <br /> SECTION 1 . DEFINITIONS : <br /> A. "Basic Service" or "Basic Broadcast Service" means any <br /> service tier which includes the lawful re-transmission of <br /> local television broadcast signals and any public , <br /> educational and governmental access programming required by <br /> the franchise to be carried on the basic tier . Basic <br /> Service as defined herein shall be subject to/governed by <br /> Federal Law. <br /> B . "Cable Service" means : <br /> 1 . The one-way transmission to subscribers of ( a) video <br /> programming, or (b ) other programming service , or any <br /> other lawful communication service , and <br /> 2 . Subscriber interaction . if any, which is required for the <br /> selection of such video programming or other programming <br /> service . <br /> C . "Cable Programming Service" or "Full Service Package" means <br /> any video programming provided over a cable system, <br /> regardless of service tier , including installation or rental <br /> `.� of equipment used for the receipt of such video programming, <br /> other than: <br /> 1 . Video programming carried on the Basic Service tier ; <br /> 2 . Video programming offered on a pay-per-channel or pay- <br />
