SECTION 6. MAPS, <br /> Subdivision 1. Incorporated by reference as Exhibit A is NSP's present "one line" map <br /> of plan construction for the year 1994 within the City. NSP shall, at such time as it <br /> submits its written acceptance of this Ordinance, contemporaneously file with the City <br /> Clerk, for approval by the City Council, a complete map showing the proposed location <br /> and size of all proposed NSP gas mains and related facilities to be installed in 1994 <br /> within the City. In addition, NSP will provide one line maps of any known future <br /> construction, according to year of projected completion, within the City. <br /> Subdivision 2. Upon request made by the City to NSP from time to time, but not more <br /> often than annually, NSP shall thereafter provide copies of its current map of gas mains <br /> and related facilities with the City. Between such periodic filing of maps, if NSP's gas <br /> mains and related facilities have been modified, NSP will make the most current map of <br /> NSP's gas mains and related facilities within the City available to the City or its <br /> representative at the NSP office in Crow Wing County upon reasonable notice to NSP <br /> from the City. In all such maps, NSP shall designate such portions of its system within <br /> the City as NSP has abandoned pursuant to Section 10 of this ordinance. <br /> SECTION 7. RESTORATION. <br /> Subdivision 1. After undertaking any work requiring of the opening of any public way <br /> or public ground, the Company shall restore the same, including paving and its <br /> foundation, to as good condition as formerly existed, and shall maintain the same in good <br /> condition for two years thereafter. The restoration shall be completed as promptly as <br /> weather permits. If the Company does not promptly perform and complete the work, <br /> remove all dirt, rubbish, equipment and material, and put the public way or public ground <br /> in said condition, the City shall have, after written notice to the Company to cure and the <br /> passage of a reasonable period of time following the notice (not to exceed five (5) <br /> business days), the right to make the restoration at the expense of the Company. The <br /> Company shall, upon written notice,pay to the City the reasonable cost of such work <br /> performed by the City. Such restoration of any public way or public ground shall <br /> include but not be limited to blacktop, concrete, retaining walls, ditches, culverts and <br /> roadways. <br /> Subdivision 2. NSP and the City agree that restoration, if any, on private property shall <br /> be the obligation and responsibility of NSP, and NSP shall hold the City harmless and <br /> indemnify the City, as provided in this franchise, with respect to any claims arising on <br /> private property, or arising out of NSP's use of private property. <br /> SECTION 8. RELOCATION. <br /> Subdivision 1. Whenever the City shall grade, regrade, or change the line of any public <br /> way, or construct or reconstruct any City utility system therein and shall, in the proper <br /> 4 <br />
