• 1 3 <br /> CITY OF PEQUOT LAKES <br /> ORDINANCE NUMBER 178 <br /> AN ORDINANCE RELATING TO THE STORM SEWER SYSTEM <br /> THE CITY COUNCIL OF THE CITY OF PEQUOT LAKES DOES ORDAIN: <br /> SECTION 1 - Storm Sewer Drainage Utility <br /> Subdivision 1 - Establishment . A storm sewer drainage system for the City of Pequot <br /> Lakes is hereby established. The municipal storm sewer system shall be operated pursuant to <br /> M.S. Section 444.075 from which revenues will be derived subject to the provisions of this <br /> Chapter and said Minnesota statutes. The storm water drainage system shall operate under the <br /> management and direction of the Roads & Streets Department, subject to direction of the City <br /> Council. Just and reasonable charges for use and availability of storm sewer drainage facilities <br /> shall be calculated and determined pursuant to the terms hereinafter contained based on expected <br /> and typical storm water run off as may be calculated within reasonable and practical limits with <br /> due regard to just and equitable charges as provided for herein. <br /> Subdivision 2 -Definitions. Rates and charges for the use and availability of the utility <br /> system shall be determined through the use of a residential equivalent factor(REF), defined as <br /> the ratio of the average volume of run off generated by one acre of typical single family <br /> residential land, during a two (2) inch rainfall event. <br /> SECTION 2 - Storm Water Drainage Fees <br /> Subdivision 1 -Fees. For the purpose of calculating storm water drainage fees for parcels <br /> of land, the REF for the parcel's storm water land use classification shall be multiplied by that <br /> parcel's acreage, and then the resulting product shall be multiplied by the storm water drainage <br /> rate, or in formula format: Fee=REF x Acreage x Rate. The REF values for the various storm <br /> water land use classifications are as follows: <br /> CLASS STORM WATER LAND USE CLASSIFICATIONS REF <br /> 1. Vacant .20 <br /> 2. Residential 1.0 <br /> 3. Medium Density, Commercial, Industrial, Institutional 2.3 <br /> 4. Heavy Density Commercial, Industrial &Institutional 4.0 <br /> For the purpose of calculating storm water drainage fees, actual acreage shall be used <br /> except for those parcels having a storm water land use classification of"Residential". As <br /> "Residential"parcels are the most numerous, and to simplify the process, the storm water <br /> drainage fee for all parcels classified as "Residential" shall be calculated using an acreage of.333 <br /> acres, or 1/3, regardless of their actual acreage. <br />
