ORDINANCE #194 AN ORDINANCE RELATING TO THE SNOW REMOVAL ON THE STREETS IN THE CITY OF PEQUOT LAKES WHEREAS, the Pequot Lakes Maintenance Department does remove snow from all city streets and roadways; and WHEREAS, parking spaces adjacent to the street should be cleared of snow; and WHEREAS, the presence of motor vehicles or other vehicles in the street and adjacent parking areas limits the ability of snow removal crews to evacuate snow in an efficient manner; and WHEREAS, snow removal on the city streets is done in the interest of public safety, THE CITY COUNCIL OF THE CITY OF PEQUOT LAKES DOES HEREBY ORDAIN: SECTION 1: DEFINITIONS A "Snow Emergency" shall be defined as the twenty-four (24) hour period following a snowfall accumulating to two (2) inches or more. In the event that a snow fall continues over an extended period of time, the snow emergency shall remain in effect until twenty- four (24) hours after the snow fall has stopped completely. The "Tow-Away Zone" shall be defined as that part of the street which is public property, whether or not it is blacktopped. SECTION 2: LIMITATIONS Vehicles shall not be permitted and must be removed from the tow-away zones between the hours of 2:00 a.m. and 8:00 a.m. during a snow emergency. SECTION 3: REMEDY In the event vehicles are present in the tow-away zones during the hours of 2:00 a.m. and 8:00 a.m. in a snow emergency, the city maintenance personnel shall be authorized to have the vehicles towed to a storage site, to be chosen at the option of the city. The owner of the vehicle shall be responsible to claim the vehicle and pay all towing costs. SECTION 4: LIABILITY The City of Pequot Lakes shall not be liable for any damage to the vehicles caused by the towing of the vehicle. 1
