Any sale of alcoholic beverages in or from any place licensed under this Article <br /> by any clerk,barkeeper or other employee in such place shall be deemed the act of the <br /> employer as well as that of the person actually making the sale. Such employer shall be <br /> liable to all the penalties provided by this ordinance for such sale equally with the person <br /> actually making the sale. <br /> Section 14. Types generally. <br /> (a) With respect to intoxicating liquor, there shall be six types of licenses: on sale, on <br /> sale club, on sale wine, Sunday on sale, temporary on sale, and off sale. On sale licenses <br /> shall permit the licensee to sell intoxicating liquor at retail for consumption on the <br /> licensed premises only. Except as provided herein, off sale licenses shall permit the <br /> licensee to sell intoxicating liquor at retail in original packages for consumption off the <br /> licensed premises only. The number of on sale intoxicating liquor licenses shall be <br /> limited to four(4)pursuant to Minnesota Statute Section 340A.413, restaurants, as <br /> defined herein, holding on sale liquor licenses shall not be included in this limit. The <br /> number of off sale licenses shall be limited to two. <br /> (b) With respect to 3.2%malt liquor, there shall be two types of licenses: on sale <br /> 3.2%malt liquor and off sale 3.2%malt liquor. On sale licenses shall permit the licensee <br /> to sell 3.2%malt liquor at retail for consumption on the licensed premises only. Except <br /> as provided herein, off sale 3.2%malt liquor licenses shall permit the licensee to sell <br /> 3.2%malt liquor at retail in the original packages for consumption off the licensed <br /> premises only. <br /> (c) An establishment whose gross receipts are at least 60% attributable to the sale of <br /> food which is the holder of an on-sale wine license and also a on-sale 3.2% malt liquor <br /> license, may also sell intoxicating malt liquors on-sale, pursuant to Minnesota Statute <br /> Section 340A.404, subd. 5b. <br /> (d) Temporary on sale licenses may be issued to existing license holders, clubs, <br /> charitable organizations, and other nonprofit organizations (in existence for three(3) <br /> years or more)permitting such entities to sell alcoholic beverages on sale. Such license <br /> shall be issued for a limited length of time, not to exceed four(4) days, and such license <br /> shall state on its face the specific dates on which it is valid. The license application shall <br /> be accompanied by insurance if insurance is required under the provisions of Minnesota <br /> Statutes Ch. 340A. The fee for such license shall be $100. <br /> (e) Before any temporary license is approved, the licensee shall make application, <br /> accompanied by the appropriate fee and including a diagram of the proposed area, the <br /> times and dates of the event,provision for insurance, and description of fencing and <br /> security measures. This application will be made to the City Clerk. <br /> (f) No alcoholic beverage license of any type shall be granted to any elective, <br /> executive or administrative officer of the city, nor to any employee of the city, nor shall <br /> Page 7 <br />
