(a) Applications for intoxicating liquor licenses shall be made to and filed with the <br /> City Clerk. On sale applications shall be made on forms prescribed by the City Council. <br /> Off sale applications shall be made on forms prescribed by the Liquor Control <br /> Commissioner. All forms shall be supplied by the City Clerk. The Council may require <br /> applicants to furnish information in addition to that contained in the written forms. If <br /> required under the provisions of Minnesota Statutes Ch. 340A, a liquor liability insurance <br /> policy shall accompany each application for a license. <br /> (b) Every application for a license to sell intoxicating liquor shall state the name of <br /> the applicant, his or her age, representations as to his or her character, with such <br /> references as the City Council may require, the type of license applied for, the business in <br /> connection with which the proposed license will operate, its location, whether the <br /> applicant is owner and operator of the business, how long she or he has been in that <br /> business at that place, an assurance indicating the building will comply with the <br /> requirements of laws relating to building, fire and health codes and such other <br /> information as the City Council may require from time to time. In addition to containing <br /> such information, the application shall be in the form prescribed by the Liquor Control <br /> Commissioner and shall be verified and filed with the City Clerk. No person shall make a <br /> false statement in an application. The police department shall investigate the applicant <br /> and report whether the applicant is a proper person to receive such license. The City <br /> Council and/or its Committee shall have at least thirty(30) days from and after receipt of <br /> the application and surety bond for review and examination of the application and surety <br /> bond prior to granting or denying issuance of a license. No license shall be valid until <br /> approved, where necessary by the State of Minnesota Liquor Control Commissioner. <br /> (c) The City Council, in it's discretion, shall have the right to refuse to issue or renew <br /> a license for the sale of intoxicating liquor on any premises on which taxes, assessments <br /> or other financial claims of the City are delinquent or unpaid. Delinquent or unpaid <br /> taxes, assessments or other financial claims of the City on the premises for which the <br /> license has been issued shall be grounds for the revocation of an intoxicating liquor <br /> license. <br /> (d) Prior to the issuance of a liquor license, the applicant shall demonstrate proof of <br /> financial responsibility as defined in Minnesota Statutes Ch. 340A and such proof shall <br /> be filed with the Commissioner of Public Safety. Any liability insurance policy filed as <br /> proof of financial responsibility under this Section shall conform to Minnesota Statutes <br /> Ch. 340A. Operation of a facility without having on file with the city at all times effective <br /> proof of financial responsibility is cause for revocation of license. <br /> (e) An alcoholic beverage license shall not be reissued to any licensee who has held a <br /> license for a period of two years or more without using said license by engaging in the <br /> business of selling alcoholic beverages on the licensed premises pursuant to said license <br /> for a continuous period of thirty(30) days or more. <br /> (f) The application for an off sale intoxicating liquor license is subject to approval by <br /> the state Department of Public Safety.
