ORDINANCE NUMBER 06-04 AN ORDINANCE AMENDING SECTIONS 5.10 AND 5.13 OF THE ZONING ORDINANCE TO INCREASE THE IMPERVIOUS COVERAGE LIMITS. The City Council of the City of Pequot Lakes does ordain as follows: Purpose and Intent. The purpose and intent of this ordinance is to amend Sections 5.10 Commercial and 5.13 Light Industrial. Section 1. Section 5.10, subpart 4A, containing performance standards for the Commercial zone, shall be amended to read as follows: A. Impervious Coverage. Impervious coverage may be increased by up to 25%, not to exceed 50% of the property, through a conditional use permit if the following information is provided and approved by the City: i. A stormwater retention plan showing containment of a 10-year, 24- hour storm event on the parcel. Section 2. Section 5.13, subpart 3, containing Lot, Use and Density Requirements, shall be amended from 25% as the "Impervious surface—percent, maximum" number to 50%. Section 3. Section 5.13, subpart 4A, containing performance standards for the Light Industrial zone, shall be amended to read as follows: A. Impervious Coverage. Impervious coverage may be increased up to 90%through a conditional use permit on properties where municipal storm sewer is available if the following is provided: i. A vegetation plan for the perimeter of the property that increases vegetation within the setbacks. ii. Direct runoff of stormwater to adjacent properties shall be eliminated through the use of berms, infiltration ponds, swales, filtration strips, or other permanent means. Section 4. Effective Date. This Ordinance shall become effective upon its passage and publication as provided by law.
