06/22/99 TEE 09:57 FAX 218 726 0823 HARI & OVEROM 21002 <br /> Resolution No. <br /> RESOLUTION TO AWARD CONTRACTS <br /> IN CONNECTION WITH WATER IMPROVEMENT PROJECT <br /> DISTRICT NO. <br /> WHEREAS, in the interest of public safety and convenience, it is necessary for the City of <br /> Pequot Lakes, Minnesota, to rehabilitate the water main of the City of Pequot Lakes. <br /> WHEREAS, the City solicited quotes in the Country Echo on March 11, 1999 for the <br /> separate stages of the construction of the water main system; <br /> WHEREAS, the City received bids submitted in response to said newspaper advertisement <br /> as shown by the abstract for bids attached hereto as Exhibit A; <br /> WHEREAS,Anderson Brothers Construction has submitted the lowest quotation and is the <br /> lowest responsible bidder meeting all specifications for Contract One (1), the Distribution <br /> System; <br /> WHEREAS, Rice Lake Contracting has submitted the lowest quotation and is the lowest <br /> responsible bidder meeting all specifications for Contract Two (2), Water Treatment Plant; <br /> WHEREAS, L,T.P, Enterprises, Inc. has submitted the lowest quotation and is the lowest <br /> responsible bidder meeting all specifications for Contract Three (3), Well Installation; and <br /> WHEREAS, Maguire Iron, Inc. has submitted the lowest quotation and is the lowest <br /> responsible bidder meeting all specifications for Contract Four (4), Water Storage Tank. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pequot <br /> Lakes, Minnesota, as follows: <br /> 1, Authorizing the City Clerk to execute the attached Contracts One (1) through Three <br /> (3)with such non-substantive changes as are authorized by the Mayor and approved <br /> by the City's legal counsel; <br /> 2. Authorizing the City Clerk to execute the attached Contract Four (4) with such non- <br /> substantive changes as are authorized by the Mayor and approved by the City's legal <br /> counsel provided that: <br /> a. In the event all owners of Brunes Royce plat fail to execute a waiver of <br /> restrictive covenant, the City Engineer is authorized to draft a "change order", <br /> thereby altering the construction plan of the Water Storage Tank to comply <br /> with the restrictive covenants currently effecting the parcel; and <br /> b. In the event the Township of Sibley fails to execute an agreement <br /> authorizing the City of Pequot Lakes the use of the right of way, the <br /> attorneys representing the City of Pequot Lakes are authorized to proceed <br />
