(218) 568-81 1 1 Mark Forsberg Police Chief <br /> Jerry Thompson Fax (218) 568-5860 <br /> E-mail: cityhall @uslink.net <br /> CITY OF PEQUOT LAKES <br /> SUBDIVISION OF LOT SPLIT RESOLUTION <br /> WHEREAS, the City of Pequot Lakes recognizes that there is a need to control and <br /> monitor illegal subdivision and lot splits within the City limits in order to ensure <br /> compliance with the City's Comprehensive Plan, as well as City zoning restrictions. <br /> WHEREAS, Minnesota Statute Chapter 272 provides for a procedure for restrictions on <br /> transfers of land within a municipality that do not comply with the municipality's land <br /> subdivision and platting ordinances; <br /> WHEREAS, Minnesota Statute Chapter 272 provides that when a deed or other <br /> instrument conveying a parcel of land is presented to the County Auditor for transfer or <br /> division, the Auditor shall not transfer or divide that land or its net tax capacity in the <br /> official records, and shall not certify the instrument as provided in Chapter 272.12 if the <br /> conveyance constitutes a subdivision under the Pequot Lakes City Code. <br /> WHEREAS, this resolution shall not apply to the transfer of a lot which was created in a <br /> plat previously approved by the City of Pequot Lakes and recorded in the office of the <br /> Crow Wing County Recorder, if the entire lot is the subject of the transfer. This <br /> resolution shall apply to the transfer, if the transfer is of a portion of a lot which was <br /> created in a plat previously approved by the City of Pequot Lakes and recorded in the <br /> office of the Crow Wing County Recorder. <br /> BE IT RESOLVED that for all conveyances of land within the City of Pequot Lakes that <br /> constitute a subdivison or lot split under the City Code, the instrument conveying the <br /> transfer must contain a certification by the City that the City's subdivision regulations do <br /> not apply or that the subdivision has been approved by the City of Pequot Lakes. <br /> WHEREUPON said resolution was declared to be passed and adopted by the City <br /> Council this 7th day of May, 2002. <br /> '411.
