RESOLUTION 05-05 <br /> CITY OF PEQUOT LAKES <br /> STATE OF MINNESOTA <br /> RESOLUTION RELATING TO AN APPLICATION FOR AN EASEMENT <br /> ACROSS STATE LAND <br /> THE CITY COUNCIL OF THE CITY OF PEQUOT LAKES HEREBY RESOLVES AS <br /> FOLLOWS: <br /> WHEREAS, Earl Hemmerich and Jeannine Hemmerich ("Hemmerich") own <br /> property located in the city of Pequot Lakes, County of Crow Wing, legally described as <br /> follows: <br /> That part of Government Lot 5, Section 15, Township 136 North, Range 29 <br /> West, Crow Wing County,Minnesota lying South of the following described <br /> line: Commencing at the southwest corner of said Government Lot 5; thence <br /> North 00 degrees 42 minutes 36 seconds West 877.27 feet, assumed bearing <br /> along the west line of said Government Lot 5, to the point of beginning of the <br /> line to be described; thence North 89 degrees 17 minutes 24 seconds East 386 <br /> feet, more or less, to the shore of Sibley Lake and said line there terminating. <br /> ("Hemmerich Property") <br /> WHEREAS, Hemmerich has requested that the City of Pequot Lakes apply for an <br /> Easement to be granted to the City of Peuqot Lakes by the State of Minnesota <br /> Department of Natural Resources ("DNR"), over DNR Administered Trust Fund land for <br /> a road Easement over property located in Loon Lake Township, County of Cass, legally <br /> described as follows: <br /> The South 600 feet of the East 33 feet of the SE '/4 SE %, Section 16, <br /> Township 136 North, Range 29 West, Cass County, Minnesota. <br /> ("Easement Area") <br /> WHEREAS, Hemmerich has agreed to pay all necessary fees associated with the <br /> acquisition of the Easement, including the application fee and the amount deemed <br /> necessary by the State of Minnesota DNR as determined through the appraisal process <br /> associated with the Easement application; <br /> NOW THEREFORE, BE IT RESOLVED, that Hemmerich shall pay all fees <br /> associated with the acquisition of the Easement, including the application fee and all fees <br /> requested by the State of Minnesota DNR as a result of the appraisal and for the <br /> acquisition of the Easement. <br />
