(1). In the case of dogs which have not been vaccinated in <br />� accordance with this Chapter which have been bitten by a <br />known rabid animal, said bitten dog shall be euthanized <br />upon written consent of the owner. <br />� <br />� <br />(2). If the owner is unwilling to have the bitten dog euthanized, <br />strict isolation of the dog in a kennel under veterinarian <br />supervision for a minimum of six (6) months shall be <br />required. The owner of the dog shall be responsible for the <br />expense thereof. <br />B. Vaccinated Animals. If the bitten dog is vaccinated in accordance <br />with the provisions of this Section, the dog shall be held as <br />follows: <br />(1). The dog shall immediately be revaccinated and confined at <br />the owner's home for a period of thirty (30) days following <br />revaccination; or, <br />(2). If the dog is not immediately revaccinated, the animal shall <br />be confined in strict isolation in a kennel for six (6) months <br />under the supervision of a veterinarian. The owner of the <br />dog shall be responsible for the expense thereof. <br />8. Any dog found off the owner's premises and not wearing a valid dog <br />license tag shall be impounded. Proof of payment of the prescribed pound fees <br />and compliance with the rabies vaccination requirements of this Chapter, shall be <br />furnished to the City Clerk's office within seventy-two (72) hours of the dog's <br />release from the pound. <br />Section 9-2.143. PENALTY FOR VIOLATION <br />1. Any person who is found to be in violation of this Article shall be guilty of <br />a petty misdemeanor. <br />2. Any person who harbors a dangerous dog or potentially dangerous dog in <br />violation to the provisions of this Article shall be guilty of a misdemeanor. <br />3. Alternatively the City may impose an administrative fine for violations of <br />this Article. The administrative fine shall be established by the City annually <br />through the Ordinance Establishing Fees and Charges, as amended from time to <br />time by ordinance. <br />Effective Date: This ordinance amendment shall be in full force and effect from and after <br />passage and publication according to state law. <br />Page 7 of 8 <br />
