CITY OF PEQUOT LAKES <br /> RESOLUTION NO. 09-33 <br /> A RESOLUTION VACATING A PORTION OF <br /> SECOND STREET (SECOND AVENUE) <br /> BLOCK ONE, <br /> FIRST ADDITION TO COLE'S PLAT OF PEQUOT <br /> CROW WING COUNTY <br /> WHEREAS, a petition signed by a majority of property owners, CLA Properties, LLC, <br /> abutting Second Street(Second Avenue) (a portion of) in Pequot Lakes was received by the City <br /> Clerk on the 1st day of September, 2009 (the "Petition"); and <br /> WHEREAS, the Petition requested that the City of Pequot Lakes (the "City"), pursuant <br /> to Minnesota Statute §412.851, vacate Second Street (Second Avenue) between Main Street and <br /> Butler Street legally described as: <br /> That part of the East 15.00 feet of Second Avenue, as dedicated in the plat of FIRST <br /> ADDITION TO COLE'S PLAT OF PEQUOT, Crow Wing County, Minnesota, <br /> lying Northerly of the Westerly extension of the South line of Lot 9, Block 1, said <br /> plat; and <br /> WHEREAS, the City Clerk reviewed and examined the signatures on said Petition and <br /> determined that said signatures constituted a majority of the landowners abutting upon the <br /> Second Street(Second Avenue) (portion of)to be vacated; and <br /> WHEREAS, a public hearing was held on October 6, 2009 before the City Council in the <br /> City Hall after due published and posted notice had been given by the City Clerk on September <br /> 17, 2009, including mailed notice to all property owners within the plat of FIRST ADDITION <br /> TO COLE'S PLAT OF PEQUOT and adjoining properties and all interested persons were given <br /> an opportunity to be heard at the City Council meeting; and <br /> 1 <br />
