� <br />�. <br />� <br />City of <br />Pequot <br />Lakes = _ <br />AGENDA ITEM #8.2 <br />REPORT TO <br />CITY COUNCIL <br />Date: March 1, 2011 <br />Subiect: Forfeiture Policy <br />Report: Paul Sandelin informed us that cities are now <br />required to adopt a forfeiture policy by March 1, 2011. <br />Below is an excerpt from the League of Minnesota Cities: <br />"The 2010 Legislature made sweeping reforms to forfeiture and <br />seizure laws in response to a state audit of the Metro Gang Strike <br />Force. Among those changes is a requirement that the Peace <br />Officer Standards and Training (POST) Board must "develop a <br />model policy that articulates best practices for forfeiture and is <br />designed to encourage the uniform application of forfeiture laws <br />statewide. " The law goes on to require all state and local law <br />enforcement agencies and "every prosecution office in the state " <br />to adopt and implement "a written policy on forfeiture that is <br />identical or substantially similar" to the POST Board model policy <br />[and that of the County Attorney AssociationJ by March 1, 2011. " <br />The attached policy is a model policy put out by the League <br />of Minnesota Cities and has been approved by Paul <br />Sandelin and reviewed by Kate Petersen. <br />
