STAFF REPORT <br /> Application: Final Plat of First Addition to Trailview Townhomes <br /> Applicant: Carl and Colleen Smith <br /> Background Information: The Planning Commission recommended approval of the <br /> Preliminary Plat of the First Addition to Trailview Townhomes in October. The City <br /> Council accepted your recommendation and approved the preliminary plat. The Final <br /> Plat is the last step in the subdivision process. <br /> Applicable Statutes: To obtain fmal plat approval, an applicant must fulfill the final plat <br /> requirements contained in the Ordinance and must meet any conditions imposed by the <br /> City during the preliminary plat approval. There was one condition included with the <br /> preliminary plat approval. <br /> 1. If the two existing wells are not used for irrigation purposes,they must be <br /> properly abandoned in coordination with the Minnesota Department of Health. <br /> In Section 140.040,the Ordinance states that the Planning Commission shall do the <br /> following relating to fmal plats: <br /> 1. The Planning and Zoning Board shall review the reports of the Attorney, Engineer and <br /> Zoning Administrator and make recommendation to the City Council. The Planning and <br /> Zoning Board shall consider the following: <br /> A. Has the applicant complied with all conditions and requirements upon which <br /> the preliminary approval is expressly conditioned either through performance <br /> or execution of appropriate agreements assuring performance? <br /> B. Does the Final Plat agree with the Preliminary Plat? <br /> C. Does the City Attorney agree that all parties with an interest in the property <br /> are shown as signers of the document? <br /> D. Does the Engineer agree that all improvements required are satisfactorily <br /> completed or are guaranteed by contract with adequate fmancial security? <br /> E. Does an independent Professional Land Surveyor agree the final document <br /> meets the statutory requirements? <br /> F. Has fmancial security been posted in the appropriate amount? <br /> Staff Findings: The following findings are provided for your consideration in the <br /> matter: <br /> 1. The final plat agrees with the preliminary plat. There were no changes <br /> required by the City for final plat approval. <br /> 2. The City Attorney has not indicated that the title work is correct and that all <br /> interested parties are shown as signers of the document. <br /> 3. There were no improvements required as part of the subdivision. <br /> 4. The applicant has provided a plat check by an independent land surveyor <br /> agreeing that the final document meet statutory requirements. <br /> March 2004-Staff Report Page 1 <br />
