STAFF REPORT <br /> Application: Request for Conditional Use Permit for a Business Office in the <br /> Agricultural Zone. <br /> Applicant: Samuel and Joan Kantos <br /> Background Information: The applicants have purchased the former Sibley Center <br /> building. They intend to move an accounting business into the building and rent out the <br /> garage space for storage. The property is zoned Agriculture. <br /> Applicable Statutes: As per an amendment to the Ordinance made at the February <br /> meeting, Section 35.030 of the Ordinance indicates that"Business Office" is allowed by <br /> Conditional-Use Permit in the AG zone. <br /> To approve a Conditional Use Permit,the Planning Commission must consider the <br /> following items: <br /> 1. The maintenance of the public health, safety and welfare. <br /> 2. The location of the site with respect to existing and proposed access roads. <br /> 3. Its compatibility with adjacent land uses. <br /> 4. Its compatibility with the intent of the zoning district in which such use is <br /> proposed. <br /> 5. Its compatibility with the objectives of the current Ordinance and its <br /> consistency with the current comprehensive land use plan. <br /> Further,the Ordinance directs that the Commission evaluate the effects of the proposed <br /> use on: <br /> 1. The prevention and control of water pollution, including sedimentation and <br /> nutrient loading. <br /> 2. Existing topography and drainage features and vegetative cover on the site. <br /> 3. The erosion potential of the site based upon the degree and direction of slope, <br /> soil type,and existing vegetative cover. <br /> 4. The need for the proposed use for a shoreland location. <br /> 5. The amount of liquid waste to be generated and the adequacy of the proposed <br /> sewage treatment system. <br /> 6. The visibility of structures and other facilities as viewed from public waters. <br /> 7. Adequacy of the site for water supply and on-site sewage treatment systems. <br /> 8. The types,uses, and numbers of watercraft that the project will generate in <br /> relation to the suitability of public waters to safely accommodate these <br /> watercraft. <br /> Staff Findings: We offer the following findings of fact for you to consider: <br /> 1. The property is located off of County Road 112. The access is existing and <br /> has been in use for many years. No new access is required. <br /> 2. Land uses adjacent to and across the street from the proposed business are <br /> either vacant, a public utility(the transformer) or agriculture. <br /> March 2004 Staff Report Page 3 <br />
