I <br /> I <br /> Staff Report <br /> Application: Conditional Use Application for Auto Rental in the Commercial Zone <br /> Applicant: Dotty Auto Company, Joe Dotty <br /> Background Information: Dotty Auto Company seeks to expand its business to include <br /> vehicle rental and service department to its existing motor vehicle sales. An automobile <br /> service business requires a conditional use permit. The existing zoning code does not <br /> directly provide for an automobile rental business. <br /> i Applicable Statutes: Section 60.030 of the Ordinance indicates that motor vehicle sales <br /> and auto repair facilities are allowed in the Commercial district by conditional use permit. <br /> Automobile rental is not a directly listed use in the Commercial district with or without <br /> 9 the conditional use permit, although it may be interpreted by the Planning Commission to <br /> be a part of an auto repair or motor vehicle sales facility. <br /> To approve a Conditional Use Permit, the Planning Commission must consider the <br /> following items: <br /> 1. The maintenance of the public health, safety, and welfare. <br /> 2. The location of the site with respect to existing and proposed access roads. <br /> 3. Its compatibility with adjacent land uses. <br /> 4. Its compatibility with the intent of the zoning district in which such use is <br /> proposed. <br /> 5. Its compatibility with the objectives of this Ordinance and its consistency with the <br /> Comprehensive Plan. <br /> Further,the Ordinance directs that the Commission evaluate the effects of the proposed <br /> use on: <br /> 1. The prevention and control of water pollution, including sedimentation and <br /> nutrient loading. <br /> 2. Existing topography and drainage features and vegetative cover on the site. <br /> 3. The erosion potential of the site based upon the degree and direction of slope, soil <br /> I type, and existing vegetative cover. <br /> 4. The need for the proposed use for a shoreland location. <br /> 5. The amount of liquid waste to be generated and the adequacy of the proposed <br /> sewage treatment system. <br /> 6. The visibility of structures and other facilities as viewed from public waters. <br /> 7. Adequacy of the site for water supply and on-site sewage treatment systems. <br /> S. The types, uses, and numbers of watercraft that the project will generate in <br /> relation to the suitability of public waters to safely accommodate these watercraft. <br /> Staff Findings: We offer the following findings of fact for you to consider: <br /> 1. The property is located near downtown Pequot Lakes with direct access to <br /> Highway 371. The access points will not change with the expanded use. <br /> x June 2004 Staff Report Page 8 <br />
