Staff Report <br /> Application: Conditional Use Permit for Motor Vehicle Sales and Service <br /> Applicant: Mark Schoeb <br /> Background Information: The applicant has applied for a conditional use permit to <br /> establish a retail car lot and detail center on the property that currently contains a car <br /> wash. The applicant is proposing a 40' x 40' building on the site for storage for all three <br /> uses. There are 18 proposed parking stalls around the building. <br /> The property is zoned Commercial. It is located along Highway 371 adjacent to the <br /> Dotty Auto Company. The existing use of a car wash would remain as part of this <br /> application. <br /> Applicable Statutes: Section 60.030 of the Ordinance indicates that motor vehicle sales <br /> and auto repair facilities are allowed in the Commercial district by conditional use permit. <br /> To approve a Conditional Use Permit,the Planning Commission must consider the <br /> following items: <br /> 1. The maintenance of the public health, safety, and welfare. <br /> 2. The location of the site with respect to existing and proposed access roads. <br /> 3. Its compatibility with adjacent land uses. <br /> 4. Its compatibility with the intent of the zoning district in which such use is <br /> proposed. <br /> 5. Its compatibility with the objectives of this Ordinance and its consistency with the <br /> Comprehensive Plan. <br /> Further,the Ordinance directs that the Commission evaluate the effects of the proposed <br /> use on: <br /> 1. The prevention and control of water pollution, including sedimentation and <br /> nutrient loading. <br /> 2. Existing topography and drainage features and vegetative cover on the site. <br /> 3. The erosion potential of the site based upon the degree and direction of slope, soil <br /> type, and existing vegetative cover. <br /> 4. The need for the proposed use for a shoreland location. <br /> 5. The amount of liquid waste to be generated and the adequacy of the proposed <br /> sewage treatment system. <br /> 6. The visibility of structures and other facilities as viewed from public waters. <br /> 7. Adequacy of the site for water supply and on-site sewage treatment systems. <br /> 8. The types,uses, and numbers of watercraft that the project will generate in <br /> relation to the suitability of public waters to safely accommodate these watercraft. <br /> Staff Findings: Based on the updated site plan we have received,we offer the following <br /> findings of fact for you to consider: <br /> October 2004 Staff Report Page 3 <br />
