Staff Report <br /> Application: Subdivision Application—Metes and Bounds <br /> Applicant: Brent Ryappy <br /> Background: The applicant owns a property at the intersection of County Road 168 and <br /> South Sluetter Road. The parcel is zoned Residential. It currently has one dwelling and <br /> three accessory structures. The property is roughly 7.5 acres. The proposed subdivision <br /> would create two lots: Parcel A at roughly 2.5 acres and Parcel B of 5 acres. The <br /> dwelling and accessory structure would both be on Parcel B. <br /> Applicable Statutes: Section 140.020(D)of the Pequot Lakes Ordinance states the <br /> design standards for subdivisions. <br /> Section 50.040 describes the minimum lot size requirements and setbacks for the <br /> Residential zoning classification. Each lot must have a minimum of 125 feet of width. <br /> Each lot must have a minimum of 30,000 square feet. <br /> Staff Findings: We have reviewed the application and propose the following findings of <br /> fact for you to consider: <br /> 1. The land is zone Residential. <br /> 2. The property is suitable for residential construction in its natural state without <br /> significant alteration. <br /> 3. Parcel B has an individual sewage treatment system that does not have a current <br /> compliance inspection. Parcel A contains adequate area for the construction of <br /> two sewage treatment systems. <br /> 4. Parcel B has access to Mayo Brook. Parcel A has no water access. <br /> 5. Parcel A is approximately 2.5 acres. Tract B is roughly 5 acres. Both lots exceed <br /> the minimum requirement of 30,000 square feet. <br /> 6. The layouts of the proposed lots are compatible with the layouts of adjoining <br /> parcels. <br /> 7. Each lot abuts more than 33 feet of the public right of way along County Road <br /> 168. Parcel A also abuts South Sluether Drive, a publicly maintained roadway. <br /> Planning Commission Direction: The Planning Commission can develop findings to <br /> recommend approval of the metes and bounds subdivision, it can develop findings to <br /> recommend denial of the metes and bounds subdivision, or it can table the subdivision <br /> request to gather additional information or provide the applicant time to modify the <br /> proposal. <br /> Staff Recommendation: Based on the findings of fact in this report,your staff <br /> recommends that the Planning Commission approve the metes and bounds subdivision. <br /> We further recommend that you give consideration to the following conditions: <br /> October 2004 Staff Report Page 11 <br />
