KALTT, HELENE TRACT SPLIT & REZONE STAFF COMMENTS 11177 <br /> RE Code: 910-361-402-B00-009 <br /> PUBLIC RESPONSES: <br /> REQUESTS: <br /> The applicant has requested to rezone approximately 1.5 acres from Rural Residential to <br /> Residential for the creation of 2 tracts. Subdivision would be by Metes and Bounds. <br /> COMPREHENSIVE PLAN: <br /> The future land use is identified as Residential. <br /> EXISTING ZONING: <br /> North: Rural Residential & Waterfront Commercial <br /> South: Middle Cullen Lake GD <br /> East: Waterfront Commercial, Wilderness Point Resort& Campground <br /> West: Residential, Mettler Point Plat <br /> PROPERTY LOCATION & ONSITE INSPECTION: <br /> The property is located with in the Shoreland district of Middle Cullen Lake GD requiring <br /> a minimum lot area riparian lots of 20,000 Sq. Ft and 100' in width for Residential Zoning. <br /> There is a dwelling with a Compliant Septic Systems on each tract. <br /> TRACT A: HOUSE: Is located approximately 40' from the OHW of Middle Cullen with <br /> little buffer between the house and Lakeshore. <br /> GARAGE: Is located less than the 10' required setback from the side <br /> property line. <br /> 'TRACT B: HOUSE: Is located less than the 10' setback as required from the side and <br /> rear lot lines <br /> PROPERTY ACCESS: <br /> There is no public road which access these tracts and no road easement crossing private <br /> land is on file. Tracts A &B are have existing driveways from a private road leading to <br /> Wilderness Point Resort. It is unknown if there is an agreement for ingress & egress to use <br /> the existing Wilderness Point Resort road. <br /> Wetlands: No wetlands have been identified. <br /> The proposed tract split appears to conform to the requirements as setforth in the Sibley <br /> Township Zoning Ordinance and Comprehensive Plan. <br /> Suggested Conditions for Tract Split: <br /> 1. Ingress & Egress Road Easement agreement to both tracts be recorded <br /> 2. Tract A; Additional vegetative screening be planted between dwelling and OHW by <br /> June 15, 2002. Planting Plan to be approved by ZA and plan be on file with P&Z <br /> office. <br /> 3. Verification of land area for each tract. <br />
