Boa 423 Pequot Lakes, MN Phone: 218 568-6699 Fax: 218 568-7229 VARIANCE APPLICATION REOUIREMENTS The Certificate of Survey should be on 8 % x11, 8 1/2 x 14 or 11x17 size paper. If any other size paper is used, 12 copies must be provided to the Zoning Office. The proposed improvements MUST BE STAKED at least 10 days prior to the Planning and Zoning Commission meeting. A Certificate of Survey must be done by a LICENSED LAND SURVEYOR for all SETBACK variance requests. The survey requirements are attached. In addition, the following information should be provided: • Show location of septic system and well • Show all existing and proposed improvements • Show all dimensions and setbacks • Building elevations • If the above items are NOT completed, your application will be deferred until the required material is received and reviewed by staff and the commission. VARIANCES shall be decided with consideration for the following: • The strict interpretation of the Ordinance would create undue hardship. • The strict interpretation of the Ordinance would be impractical because of circumstances relating to lot size,shape,and topographic or other characteristics of the property not created by the landowner. • The deviation from the Ordinance,with any attached conditions,will still be in keeping with the spirit and intent of the Ordinance. • The variance will not create a land use NOT PERMIT TED in the zone. • The variance will not alter the essential character of the locality. • The variance is NOT for economic reasons alone,but reasonable use of the property does not exist under the Ordinance. Please state the nature of the Variance you are requesting: I am requesting a variance from the ten foot setback. The northwest corner of my garage currently encroaches about 10 inches into the setback area. Explain the hardship which this variance would alleviate: Absent the variance, it would be necessary for me to demolish my garage, remove the slab and reconstruct the garage to rectify an encroachment of only 10 inches on the setback.
