f. The Board of Adjustment and City staff shall have the authority to request additional information from the applicant <br /> concerning the variance or to retain expert testimony with the consent and at the expense of the applicant concerning said <br /> variance where said information is declared necessary to insure preservation of health,safety and general welfare. <br /> g. Upon receiving the report and recommendation of the Board of Adjustment and City staff,the City <br /> Clerk shall place the report and recommendation on the agenda for the next regular meeting.The <br /> Board of Adjustment shall request the City Clerk to set a date for a public hearing. Notice of such <br /> hearing shall be published in the official newspaper at least ten(10)days and no more than thirty <br /> (30)days prior to the hearing to all owners of property within three hundred fifty(350)feet of the <br /> parcel included in the request. <br /> h. Failure of a property owner to receive said notice shall not invalidate any such procedures as set <br /> forth within this Ordinance <br /> i. The Board of Adjustment shall hold whatever public hearings it deems advisable and shall make its <br /> decision upon the proposal to grant a variance. <br /> j. Upon receiving the report and recommendation of the City staff,the Board of Adjustment shall make <br /> a recorded finding of fact and impose any conditions it considers necessary to protect the public <br /> health,safety and welfare. <br /> k. The Board of Adjustment shall decide whether to approve or deny a request for variance within thirty (30)days after the <br /> public hearing on said request. <br /> I. The granting of variance of this Ordinance shall be by majority vote of the full Board of Adjustment. <br /> m. The City Clerk shall notify the originator of the variance request of the Board of Adjustment's decision in writing. <br /> n. The petitioner may within 45 days from the date of the decision of the Board of Adjustment,file with the City Clerk an <br /> appeal to the City Council. <br /> o. The City Council shall at its next regular meeting after the filing of an appeal to it from a decision of the Board of <br /> Adjustment,set a date for a hearing thereon,which shall be no later than 60 days after the meeting,after hearing oral or <br /> written views of interested persons, the City Council shall make its decision at the same meeting or at a specified future <br /> meeting. <br /> ARTICLE XI <br /> ADMINISTRATION <br /> SECTION 11.10: ADMINISTRATION-PLANNING COMMISSION <br /> The Planning Commission shall consist of five(5)members appointed by the Council. Members shall be residents of the City <br /> of Pequot Lakes. All members shall be appointed for a term of three(3)years, provided that each member shall serve until his <br /> successor is duly appointed. Members of the Commission may be compensated in an amount determined by the Council and <br /> may be paid their necessary expenses in attending meetings of the Commission and in the conduct of the business of the <br /> Commission. <br /> SECTION 11.11:OFFICERS <br /> A Chairman and Secretary shall be elected annually from among the members of the Planning <br /> Commission at the January meeting. <br /> C:IOPLIMITIDOCS1ord#163.doc 24 <br />
