classification is permitted by law. All other classifications will be negotiated by Town and City. In the year of annexation of any of the land subject to this agreement,there shall be no apportionment of real estate tax income for the year in which the annexation takes place. The Town shall receive all such income. State aid income and federal income shall likewise not be apportioned, unless required by federal or state law. Any dedicated road or park funds affected by annexation, shall be turned over to the city within 15 days after the date of the annexation order. Any annexation which involves accounts receivable for dedicated roads or park funds, to be collected in the future shall be forwarded by the Town to the City. 8. Trunk Reserve or Excess Sewage Capacity Fund: Upon recovering its costs for development of commercial or industrial properties from areas annexed pursuant to this Joint Resolution and Agreement,the City shall,for a period of five(5)years dedicate twenty-five percent(25%)of the City's share of property taxes of said areas to a separate"Trunk Reserve"or"Excess Sewage Capacity"fund for the purpose of developing oversizing for public sanitary sewer and excess sanitary sewer capacity for residents. The City and the Town shall mutually develop guidelines for the use of these funds. Said guidelines shall be adopted by a majority vote of both the Town Board and the City Council acting as separate bodies. 9. Transitional Sub-Committee: The City and the Town mutually agree to create a Transitional Sub-Committee as a part of this agreement. Membership on the Transitional Sub-Committee shall consist of an equal number of Board Members from each Planning Commission. This sub-committee shall deal with transitional annexation issues and make recommendations to respective Town and City Planning Commissions. Whenever a Town resident who is a member of the sub-committee becomes a resident of the City as a result of annexation,that member may continue on the sub-committee until a new member is appointed by the Town Board,or until their term expires,after which a new member shall be appointed by the Town Board. The Transitional Sub-Committee shall be responsible for advising their respective Planning Commissions as to land and controls in the orderly Annexation Area. a. The City and the Town mutually agree that the Transitional Sub-Committee will review, on a continuous basis, the factors impacting orderly annexation and will report to the Town Planning Commission and Board and the City its recommendations for changing the conditions for orderly annexation and the desirability of annexing specific areas including the remaining Town. The first such report shall be presented to the Town and the City 6 months from the effective date of this resolution. 10. Agricultural, Forestry,Rural Preservation: The City and the Town mutually agree that the preservation and protection of agricultural,forestry and the rural atmosphere is beneficial and shall immediately take steps to establish a preservation policy pursuant to Minnesota Statutes. Such a program will be subject to review of the Transitional Sub- Committee,and shall be implemented within one year after the effective date of this Joint Resolution and Agreement. 11. Joint Cost Sharing: The Town already participates in the cost-share of the Fire Department of the City. The Town agrees to cost-share in the participation of the City Police Department. These projects shall be reviewed and adjusted annually. 12. Employee Transfer: The City must assimilate current Town personnel in the City's work force. This would take place when the Town has reached the final stages of annexation. DRAFT
