STAFF REPORT <br /> Application: Request for a Re-Zoning from Industrial(I)to Commercial(C). <br /> Applicant: Joe Berquist <br /> Background Information: The applicant owns 4.72 acres of property behind the <br /> Liberty Tool building. The property is entirely within the City of Pequot Lakes (none in <br /> Sibley Township) and is bordered by the commercially zoned Landecker and Associates, <br /> Liberty Tool(zoned industrial) as well as other commercial and residential property to <br /> the north. The property is currently vacant. <br /> The applicant would like to rezone the property from Industrial to Commercial. <br /> Applicable Statutes: As with the numerous rezoning requests we have had over the last <br /> few months, the burden is higher than in most other land use applications. By state law, a <br /> 4/5ths majority of the Council is required to rezone a property, where a simple majority is <br /> needed in most other instances. The Commission must determine if the property zoned <br /> incorrectly? If the property is zoned incorrectly, the Commission must then determine <br /> what would be the correct zoning classification for this parcel? <br /> Staff Findings: We offer the following findings for consideration by the Planning <br /> Commission. <br /> 1. The parcel in question is not adjacent to any other industrial zone except for <br /> Liberty Tool(formerly Kintzie Candles). It has the characteristics of a spot <br /> zone. <br /> 2. The property was rezoned to Industrial in the past to accommodate the Kintzie <br /> Candles development. This parcel was split from the original Kintzie Candles <br /> property. <br /> 3. Transportation access to the site is excellent. The site is highly accessible due <br /> to the close proximity to downtown Pequot Lakes and the County Highway. <br /> 4. Adjacent land uses are commercial with some residential to the north. <br /> 5. There are other vacant industrial-zoned properties within the industrial park <br /> that the City would like to have developed. <br /> Planning Commission Direction: The Commission can recommend to the Council that <br /> t_ they approve this rezoning. The Commission can also recommend that the Council not <br /> approve the rezoning. Finally, the Commission can table the rezoning to gather further <br /> information or schedule a site visit. <br /> i <br /> Staff Recommendation: Based on the findings, your Staff recommends that the <br /> Commission approve the request. <br /> 1. <br /> It would seem that the Industrial zoning of this parcel is a spot zone that was potentially <br /> done to accommodate a specific development (Kintzie Candles) that no longer exists. <br /> I <br />
