August 9, 2003 Mr. Dan Volk&Ms. Linda Richards DBA Wilderness Resort Box 84 Nisswa, MN 56468 Re: Wilderness Resort PUD Dear Mr. Dan Volk&Ms. Linda Richards: It is my understanding that Dawn Bittner has sent you an application for a conditional use permit. In order to modify your Planned Unit Development you must go through the conditional use process. We wanted to get you an application right away as you will need to get it submitted soon if you want to be on the September agenda. Just to be clear, however,we are not recommending that you amend your conditional use permit. While you certainly have a right to apply,we do not want you under the impression that we believe the application would be well received by the Planning Commission or the public or that the application would ultimately be approved. Our original contact with you earlier this year was in response to numerous inquiries from the public. Those inquiries went through the Planning Commission,who directed us to review your existing Conditional Use Permit as they believed you were approved for tent sites only along the shoreline. We confirmed their belief, and were instructed to contact you to have the RV units removed. Complaints with the property dealt with the visual and environmental impacts of having sites so close to the lake. It is certain that these issues will come up as part of a request to amend and intensify the existing permit. We still have an agreement that the RV's will be removed by Labor Day. That agreement was made to resolve a violation of the ordinance, and we believe the City has been very accommodating by allowing you to phase out your agreements over the summer. We trust the units will be removed as per our agreement. If you have any questions or wish to discuss this further,please do not hesitate to contact us.
