Please note that the <br /> legal tax records at Crow Wing County show one owner for the property in question, that <br /> being E.E. MacGibbon. Apparently, the taxes have been paid in the name of the <br /> deceased for nearly forty years. None of us are attorneys, but we would recommend that <br /> you check with Crow Wing County and make sure that the legal records reflect your <br /> understanding of the situation. <br /> We really can't deal with anyone except for the legal owner, and obviously if E.E. <br /> MacGibbon is deceased, neither we or Crow Wing County knows who the legal owner <br /> actually is. <br /> A great deal of information had been sent to your address, including an April 3, 2002 <br /> certified letter indicating that the sewer system was being inspected and giving the <br /> property owner an ability to object. The signature on the letter appears to be that of a <br /> James MacGibbon, although it is not completely legible. <br /> A report on the sewer inspection had also been sent to this address. I will try and obtain <br /> another copy of this report for you. <br /> The City has an obligation to protect the health and welfare of the community. The <br /> sewage treatment system on the property has been identified as failing, and that is <br /> indisputably a threat to the public health and welfare as well as a violation of State of <br /> Minnesota Rules, Chapter 7080. We would very much like the opportunity to work with <br /> someone associated with the ownership of this property to find a way to upgrade the <br /> system to be in conformance. <br /> Barring such an arrangement, I do believe we have some obligation to act to address this <br /> situation. I don't think we are close yet to going down that path. I think there is plenty of <br /> time here for us to work together and find a solution. That is what we want to do. <br /> We are going to contact the County and have them confirm the ownership of the <br /> property. Would you please have someone who you believe to be the owner of the <br /> property contact us right away. <br />
