STAFF REPORT
Application: Rezoning in the Medium Density Residential District to the Exempt
Commercial Zoning Classification.
Applicant:Jim Brunes
Background Information: Mr.Bruns would like to purchase a property in the MR
District for commercial use. He is requesting a rezoning of the proposed lot to the
Exempt Commercial classification. This parcel is located on West Sibley Street directly
west of the current Exempt Commercial District. A residence is currently situated on the
parcel. The parcel is currently zoned Multi-Family Residential.
Applicable Statutes: When examining a rezoning request, the burden is higher than in
most other land use applications. By state law,a 4/5ths majority of the Council is
required to rezone a property, where a simple majority is needed in most other instances.
Simply put, there are two questions that must be answered during a rezoning. First,is the
property zoned incorrectly? Second, if the property is zoned incorrectly, what would be
the correct zoning classification for this parcel?
Considering the City is currently going through a comprehensive planning process,an
additional question may be,is the location of this parcel as a commercial use consistent
with the City's vision for future land use?
Staff Findings:We have reviewed the application and propose the following findings of
fact for you to consider.
1. The parcel is currently zoned Medium Density Residential.
2. The present development on the parcel is single-family residential.
3. The parcel topography is flat.
4. The parcel is directly west of the Exempt Commercial District.
5. The parcel is grouped with the downtown commercial area in the proposed
Future Land Use Map as an Urban Commercial land use.
6. At this stage in the comprehensive planning process, rezoning this parcel to a
commercial use is consistent with the City's vision.
Planning Commission Direction: The Commission can recommend to the Council that
they approve this rezoning. The Commission can also recommend that the Council not
approve the rezoning. Finally, the Commission can table the rezoning to gather further
information.
Staff Recommendation: We recommend that the Planning Commission approve the
rezoning request based on the findings provided in this report.
CITY OF PEQUOT LAKES PAGE 1
JUNE 2003 STAFF REPORT
