City of Pequot Lakes/Sibley Township <br /> Planning Commission Meeting <br /> March 26,2002 <br /> Present:Joe Dotty,Donna Thurshank,Marty Nelson,Bill Habein,Mary Pfeiffer,Cheri Seils,Craig <br /> Nagel,Tom Woog,John Derksen,Dennis Slayton,Dawn Bitner,Cathy Malecha <br /> Guests: Tom Fitzpatrick,Mike Loven,Sharon Thurlow,Don Porter,Ron Hardy <br /> Tom Fitzpatrick,attorney for both City of Pequot Lakes and Sibley Township,gave a presentation <br /> on the legal issues pertaining to hearings and their ramifications. <br /> 1. Adopt Specific Rules for conducting your hearings. <br /> 2. Large group on panel-name each individually for taping purposes <br /> 3. Motion based on specify comp plan and Ordinance <br /> 4. I move stating the specifics of reasoning. <br /> 5. Staff comments should be given to applicant if possible a head of hearing date. <br /> 6. Variance-make sure you have a clear record according to 7 statements required to grant <br /> or deny a variance <br /> 7. Due process-make sure applicant has reasonable consideration and time to present his <br /> views. <br /> 8. Treat each applicant separately,do not make judgements from previous applicants or <br /> testimony. Each application is separate. <br /> Mike Loven was present to answer questions concerning the possibility of not having 66 ft wide <br /> roads. Mike stated that you could not go narrower then 40 ft width due to utilities. You could put a <br /> utility easement at the edge of the road. But,if and when the utilities would need to be moved it <br /> would be at the expense of the City. Snow removal is also a factor to be considered. <br /> `-- Another suggestion was in new developments to put the Sewer and Water on one side and the phone <br /> etc.on the other. <br /> Craig suggested that we meet with T.D.S.at some point and come up with a plan which has been put <br /> together by all interested parties(ie. City,P&Z,and utilities). <br /> Mike asked if there could be an Ordinance which would give power of enforcement to someone in <br /> regard to retaining walls,huge boulders and sprinkler heads in the right of way. These when <br /> covered with snow or foliage could be hit by maintenance vehicles. <br /> Mike and Dennis will meet and do no-sites for road approaches. <br /> Sharon Thurlow and WSN made a presentation on the proposed new senior-living facility for the <br /> City of Pequot Lakes. This was an information session. Permits and hearings will be done at a later <br /> date. <br /> Mr.Don Porter and Roger Hardy presented their project for the former Rathke property which is <br /> now owned by Mr.Porter. Roger Hardy would like to build a Leisure Home Sales Center on the <br /> property. The property is located in residential area. No final commitments were made after <br /> discussion of the project. <br /> A motion was made by John Dotty and seconded by Cheri Seils to accept the Park Ordinance <br /> Division 110 Section 120-010,voice vote all ayes with the exception of Martin Nelson who voted No. <br /> Amending of by-laws wait until April meeting. <br /> Discussion concerning the time and date of Planning Commission meetings was addressed.
