MINUTES <br /> PEQUOT LAKES PLANNING AND ZONING COMMISSION <br /> OCTOBER 16,2003 <br /> PRESENT: Bill Habein, Marty Nelson, Cheri Sells, Joe Dotty, Karl Moon, Tom Woog, <br /> and John Derksen. ABSENT: Mark Hallan. <br /> PLANNING AND ZONING ADMINISTRATOR: Charles Marohn. <br /> The meeting was called to order by Chairman Tom Woog at 6:30 p.m. <br /> APPLICANT: Joyce Mikesh and Jerry Solomon. <br /> Applicant requests Preliminary Plat approval of Voyagers Pass. <br /> Applicant was present: Joyce Mikesh, 22163 County Road 3, Merrifield, MN. <br /> Mr. Marohn explained his Staff Report. Kevin McCormick, Landecker and Associates, <br /> was in attendance representing the Applicants. There was discussion regarding the road <br /> and whether it could be extended. He explained that the owner of the property to the <br /> north was not interested in development at this time. The Park Dedication Fee and <br /> whether or not Outlot A would be a private or public park was also discussed. Outlot A <br /> is currently 7.5 to 8 percent of the plat and could be increased to 40,000 sq. ft. The <br /> Outlots are attached to the lake lots and Wit were a public road and park, there would be <br /> safety issues. There also is no parking for public use and City Staff would have to <br /> maintain it. Mr. Marohn explained that the Park Dedication Fee is 10% of the assessed <br /> value of the land before subdivision. <br /> Dick Bunker,North Sluetter Road, Pequot Lakes, expressed concern over control and <br /> enforcement of Outlot A. His concern was that it may become a party area. <br /> Mr. Marohn suggested as an alternative to the 10% Fee, to obtain from the County <br /> Assessor 10% of the entire parcel and 10% of Outlot A, and the difference between the <br /> two be the Dedication Fee. Mr. Marohn also indicated that the Park Dedication Fee is <br /> determined at Final Plat. <br /> A motion was made by John Derksen, seconded by Karl Moon, to approve the <br /> Preliminary Plat of Voyagers Pass, subject to the following conditions: <br /> 1. The applicant shall present a deed restriction or similar device to restrict <br /> ownership and use of Outlots B thru F in a manner acceptable to the City <br /> Attorney. Ownership shall be as indicated on the preliminary plat. Each lot shall <br /> be used only for construction of one accessory structure and may not contain <br /> elements of human habitation. <br />
