MINUTES <br /> PEQUOT LAKES PLANNING AND ZONING COMMISSION <br /> April 17, 2003 <br /> PRESENT: Bill Habein, Marty Nelson, Joe Dotty, Cheri Seils, Karl Moon, Tom <br /> Woog, and Mark Hallan. ABSENT: John Derksen. <br /> ZONING ADMINISTRATOR: Charles Marohn. <br /> The meeting was called to order by Tom Woog, Commission Chairperson, at <br /> 6:35 p.m. <br /> APPLICANT: Dave and Jean Buck <br /> Applicant requests a variance to construct within the shoreline setback and within <br /> the side yard setback. <br /> Applicant Dave Buck, Lake City, Minnesota, was in attendance. <br /> Mr. Marohn explained his Staff Report. When asked, Mr. Buck explained that the <br /> new structure would be 2 feet wider and 4 feet longer than the existing cabin. <br /> There is no other reasonable alternative than the holding tank. It was inspected <br /> last summer and is in compliance. The existing deck will be removed. <br /> A motion was made by Karl Moon, seconded by Joe Dotty, to grant the variance, <br /> subject to the following conditions: <br /> 1. There shall be no removal of mature trees (greater than 4" diameter) <br /> on the property and the property owner shall obtain a signed <br /> acknowledgment from the adjacent property owner indicating that they <br /> understand the new dwelling will encroach within the setback. <br /> 2. To maintain the character of the surrounding area, the proposed cabin <br /> shall not exceed 25-feet in height average as measured from the <br /> existing grade to the peak of the roof. <br /> 3. To reduce impervious coverage as much as reasonably possible, to <br /> control stormwater runoff and to reduce the number of non- <br /> conformities on the property, the applicant shall permanently remove <br /> the existing deck that encroaches 31 feet from the lake. <br /> 4. To control stormwater runoff, runoff from around the home and in the <br /> rear of the home shall be contained using berms and shallow swales. <br /> The existing railroad tie retaining wall shall be replaced with an <br /> environmentally friendly retaining system such as keystone or natural <br /> rock. The retaining wall shall be raised to withhold and contain <br /> stormwater runoff from the site so that there is no direct flow of <br /> stormwater from the home into the lake. <br />
