MINUTES <br /> PEQUOT LAKES PLANNING AND ZONING COMMISSION <br /> March 20, 2003 <br /> PRESENT: Bill Habein, Marty Nelson, Tom Woog, Mark Hallan and John <br /> Derksen. ABSENT: Joe Dotty, Cheri Seils and Karl Moon. <br /> ZONING ADMINISTRATOR: Charles Marohn. <br /> The meeting was called to order by Tom Woog, Commission Chairperson, at <br /> 6:30 p.m. <br /> APPLICANT: City of Pequot Lakes <br /> Applicant requests to establish/clarify zoning classification. <br /> Mr. Marohn explained his Staff Report. <br /> Mr. Don Bye was in attendance representing the Tulenchiks. He had submitted a <br /> letter to Staff just prior to this meeting indicating the findings of fact to support a <br /> Commercial zoning classification, a copy of which is attached. <br /> A motion was made by Mark Hallan, seconded by Marty Nelson, to affirm a <br /> Commercial zoning classification, based on the following findings of fact: <br /> 1. On July 12, 2001, the applicants, NWT, LP and Chris Swenson petitioned <br /> to have the described property annexed to Pequot Lakes for anticipated <br /> commercial development. <br /> 2. On July 13, 2001, applicant met with representatives of the Pequot Lakes <br /> Planning Commission, City Council and staff. The commercial aspects of <br /> this project were discussed along with procedures. <br /> 3. On July 17, 2001, the Pequot Lakes City Council met and accepted the <br /> petitions for annexation. <br /> 4. On July 17, 2001, the Pequot Lakes Planning Commission met and <br /> passed a resolution recommending annexation of the described property <br /> and specifically resolved that it be zoned commercial. <br /> 5. A written notice of a public hearing was sent to fourteen adjacent <br /> landowners; and a notice of public hearing was published in the City's <br /> legal newspapers, and a public hearing and scheduled council action of <br /> the annexation and intention of zoning commercial were made a matter of <br /> public knowledge as well as public record from July to October 2001, <br /> which altogether constituted substantial compliance as to notice <br /> requirements. <br />
