the uses, from the standpoint of run off volume for the standard rainfall event. An appeal <br /> of such classification from the determination of the Roads& Streets Department may be <br /> made to the City Council within sixty (60) days following the mailing of the <br /> classification to the owner. <br /> 3. Adjustments. The City Council may by resolution adopt policies providing for <br /> the adjustment of charges for parcels based upon land use data supplied by affected <br /> property owners which demonstrates a run off volume for a standard rainfall event <br /> substantially different from the REF being used for such parcels (such adjustment for <br /> storm water management charges shall not be made retroactively). A credit of up to 50% <br /> of the storm water management charges may be given if the property owner has or <br /> develops on-site retention of the storm water. <br /> 4. Exemption. Public street right-of-way is exempt from storm water drainage <br /> charges. <br /> Section 15-3. 3. PAYMENT OF CHARGES <br /> 1. Charges. Statements for storm water management charges shall be made a part of <br /> the present utility billing system invoiced through the City Clerk's Office for the City of <br /> Pequot Lakes on a monthly or annual basis. <br /> 2. Recalculation of Charge. If a property owner or person responsible for paying the <br /> storm water management charge questions the accuracy of an invoice, such person may <br /> have the determination of the charge recalculated by written request to the City Council <br /> within sixty (60) days following the mailing of the invoice by the City. <br /> 3. City to establish Billing System. The user charges provided for in this article <br /> shall be collected by the City through a period billing and collection procedure,to be <br /> established in regular form by the City, and such procedure shall be effective upon <br /> approval of the Council by resolution. Such procedures shall include a late penalty <br /> provision. Each billing for storm water management charges which are not paid when <br /> due shall incur a penalty charge of$5.00 per month. <br /> 4. Owner Responsible for Payments. The owner of the real estate or premises shall <br /> be responsible for payment of the storm water management utility charge. <br /> 5. Collection with Real Estate Taxes. Any past due storm water management <br /> charges will be certified to the County Auditor for collection with real estates taxes in the <br /> following year pursuant to Minn. Stat. §444.075, Subd. 3. In addition,the City shall have <br /> the right to bring a civil action or take other legal action available to it under Minnesota <br /> law to collect unpaid charges. <br /> 6. Establishment of tax lien. Any past due storm water management charges will be <br /> certified to the County Auditor for establishment of a tax lien pursuant to Minn. Stat. <br /> �... §444.075, Subd. 3.
