deferred until the next council meeting without loss to the city through forfeiture of discount privileges
or otherwise, it may be made immediately if the itemized claim is endorsed for payment by at least a
majority of all the members of the council. The claim shall be acted upon formally at the next council
`" meeting in the same manner as if it had not been paid, and the earlier payment shall not affect the right
of the city or any taxpayer to challenge the validity of the claim.

The League said the bottom line is that we are trying to avoid late payment ar affecting the City's credit.
If we need to change our policy to make it clearer, perhaps you could provide me with some different
language to present to the Council for future occurrences. If this payee is missing from any council approved listing, section 1 does
not apply. Section 2 does not work as it only applies to claims that are "NOT regular and recurring," which this
payment is.
Also please give the specific cite from the State Statute you are using to make this payment. If you find one that
is specific to this payment, then my question is: why would Nancy ask the Council to "APPROVE" the payment
via e-mail if we are not taking an official action? I would have expected only an FYI that this is made under our
bond agreement and authorized under MN Statute ### and that it will be affirmed in the next Council packet for
approval. (This is not what was done!)
The fact that other Council Members "approve" is only pertinent if they are taking official action.
Since the payment has been sent, this whole discussion is probably mute. But in addition to the above
question, please tell me, which is it: 1) payment allowed by Statute or 2) Payment made pursuant to Council
— action via e-mail? Thanks.
12/23/2010
