13. The surrounding neighborhood is largely undeveloped land with residences clustered <br /> along the lakes. <br /> 14. The proposed use should not be injurious to the public as necessary permits for <br /> stormwater and pollution control will be obtained, as well as permits for noise and air <br /> emissions. It is unclear whether there is a potential for groundwater contamination at <br /> this site given the level of excavation and general sandy soil type in the area. <br /> 15. The proposed use has the potential to be injurious to the use and enjoyment of existing <br /> residences in the area.All of the residences are at least 500 feet from the project site,but <br /> associated project noise from general operations has the potential to interfere with the <br /> enjoyment of the nearby lake properties. <br /> 16. The proposed use will not impede the normal and orderly development of surrounding <br /> vacant properties for uses predominant in the area as adjoining properties are zoned <br /> Forest Management and Agriculture. <br /> 17. The proposed use will not require public facilities or services at public cost as the <br /> applicant has indicated that they will maintain their haul route.Section 8.5, Subdivision <br /> 3 of the Ordinance does contain a provision requiring the applicant to furnish a bond to <br /> guarantee that rehabilitation, reclamation, and restoration are completed to the <br /> satisfaction of the City. <br /> 18. The proposed use has the potential to create traffic congestion on Highway 371 at their <br /> access point. The applicant intends to work with the Minnesota Department of <br /> Transportation to establish appropriate turn lanes and passing lanes to minimize <br /> congestion. <br /> 19. The applicant has indicated that no parking changes will take place at this site, but has <br /> not indicated where employees will be parking. However,given the size of the site,there <br /> is more than ample space for off-street employee parking. <br /> 20.The applicant has indicated that they intend to meet all EPA noise level requirements <br /> and do not plan to use blasting or other explosives at the site. In addition,the applicant <br /> has indicated that dust will be controlled with calcium chloride on the haul road and site <br /> entrance,with eventual paving of the haul road. <br /> 21. There are not any significant historic, natural,or scenic features located on the property <br /> that would be damaged or destroyed by the proposed use. The site had previously been <br /> clear cut for timber purposes. <br /> 22.It is unclear whether the proposed use will contaminate groundwater as the proposed <br /> extraction would take place at least two(2)feet above the water table. <br /> Planning Commission Direction:The Planning Commission can decide to approve or deny <br /> the conditional use permit application.The Commission can also choose to table the application <br /> if additional information is needed to make a decision. <br /> Staff Recommendation: Because of the questions about the potential environmental impacts <br /> from the proposed use, the Staff recommends tabling the application until it is shown that <br /> impacts discussed above are minimal or can be avoided. <br /> Should the Planning Commission feel inclined to move forward with the application, the <br /> following issues should be discussed and addressed in addition to any other issues that may not <br /> be listed here: <br /> 1. Stormwater management <br /> 2. Groundwater contamination <br /> 3. Restoration and rehabilitation of the site after completion of work <br /> 4. Erosion control measures <br /> 5.
