Lot,Use and Density Requirements. <br /> Lot Width-feet,minimum....................................................................................200 <br /> Buildable Lot Area—acres,minimum........................................................................5 <br /> Accessory Structure Size—square feet,max,cumulative...2,000 for first 2.5 acres <br /> ...............................................................................i,000 for each additional 2.5 acres <br /> Maximum Animal Unit per Acre............................................................................0.5 <br /> The Ordinance defines an animal unit as a unit of measure based on the approximate <br /> production of wastes from i000 pounds of live weight of poultry or animals, indicating that one <br /> horse is equivalent to 1.4 animal units. <br /> Staff Findings: The Staff provides the following findings for the Planning Commission's <br /> consideration: <br /> 1. The rezoning to Transition Residential is consistent with the City's Comprehensive Plan <br /> and Future Land Use Map. <br /> 2. The rezoning to Rural Residential does not conform to the Future Land Use Map,but the <br /> Future Land Use map does designate properties just to the north of the subject property <br /> as Rural Residential and Agriculture. <br /> 3. The parcel is bordered on the north, east, and south by properties that the City has <br /> proposed to be rezoned Transition Residential; the owner of the property, Greer, is <br /> requesting that the properties be rezoned to Urban Residential. <br /> 4. The parcel is bordered on the west by properties that are zoned Transition Residential <br /> and Urban Residential. <br /> 5. The Transition Residential zone is compatible with Urban Residential and Agriculture <br /> zones. <br /> 6. The Rural Residential zone is compatible with the Transition Residential and Agriculture <br /> �. zones,but is not compatible with the Urban Residential zone. <br /> 7. The properties were zoned Agricultural under the previous ordinance, which had a <br /> minimum lot area of 20 acres and a minimum lot width of 500 feet. Rezoning to <br /> Transition Residential or Rural Residential would not be down zoning. <br /> 8. The parcel area of 5.5 acres meets the minimum lot area of 5 acres for the Transition <br /> Residential and Rural Residential zones. <br /> 9. The parcel lot width of 375 feet meets the minimum lot width of 200 feet for the <br /> Transition Residential zone and 200 feet for the Rural Residential zone. <br /> 1o. Animal boarding facilities are excluded uses in the Transition Residential zone, but are <br /> listed as a conditional use in the Rural Residential zone. <br /> 11. Having 5.5 acres,the property would be allowed to have 2.75 animal units, regardless of <br /> whether the zoning classification was Rural Residential or Transitional Residential. As <br /> horses are measured as 1.4 animal units, this would amount to 1.96 horses. The <br /> Ordinance does not indicate whether the number should be rounded up or rounded <br /> down. <br /> Planning Commission Direction: The Planning Commission can recommend that the City <br /> Council approve,deny,or table this rezoning. <br /> Staff Recommendation: Based on the findings of fact presented in this report, the Staff <br /> would recommend that the property be rezoned to Rural Residential. Rural Residential zoning is <br /> consistent with the Comprehensive Plan, is compatible with surrounding zones provided that <br /> those zones do not change to Urban Residential, and meets the purpose and intent of the <br /> district. Rural Residential zoning also allows the property owner to continue the current uses as <br /> conforming uses, rather than non-conforming uses. This difference gives the property owner <br /> more flexibility in the operation and expansion of the existing animal boarding facility, as the <br /> facility would then be considered a conditional use. <br /> City of Pequot Lakes Staff Report 4-3 <br /> October 20,2005 <br />
