STAFF REPORT <br /> Application: Rezoning of City to New Zoning Classifications <br /> Applicant:City of Pequot Lakes <br /> Background Information: On August 3, 2004,the City of Pequot Lakes adopted a new <br /> Comprehensive Plan and Future Land Use Map.As part of the implementation of the <br /> Comprehensive Plan,the City updated and adopted a new Land Use and Subdivision Ordinance <br /> on June 7,2005 that conforms to the Future Land Use Map in the Plan and moves the City <br /> forward in executing the policies set forth in the Plan. <br /> The Draft New Zoning Map was presented at the last Planning Commission for discussion <br /> purposes and residents were given the opportunity to comment or ask questions about the new <br /> zoning classifications.Any resident who wished to have a separate rezoning hearing had the <br /> opportunity to sign up for a separate rezoning and those properties will be left out of this phase <br /> of the rezoning process. <br /> Applicable Statutes: Section 5.1, Subdivision 7 outlines the criteria that should be considered <br /> when amending the official zoning map or establishing a zoning classification: <br /> A. Preservation of natural sensitive areas. <br /> B. Present ownership and development. <br /> C. Shoreland soil types and their engineering capabilities. <br /> D. Topographic characteristics. <br /> E. Vegetative cover. <br /> F. In-water physical characteristics. <br /> G. Recreational use of surface water. <br /> H. Road and service center accessibility. <br /> I. Socio economic development needs of the public. <br /> J. Availability of public sewer and water utilities. <br /> K. The necessity to reserve and restore certain areas having significant historical or <br /> ecological value. <br /> L. Conflicts between land uses and impacts of commercial uses or higher densities on <br /> adjacent properties. <br /> M. Alternatives available for desired land use. <br /> N. Prevention of spot zoning. <br /> O. Conformance to the City of Pequot Lakes Comprehensive Plan. <br /> P. Conformance to the City of Pequot Lakes Future Land Use Map and any other official <br /> maps of the City. <br /> Chapter 5 of the Ordinance details the purpose and intent for each of zoning classifications <br /> including: <br /> • Open Space <br /> • Water Resource <br /> • Forest Management <br /> • Agriculture <br /> • Rural Residential <br /> • Transition Residential <br /> July 2005 Staff Report 4-{PAGE <br /> } <br />
